The presidential candidate of the Peoples Democratic Party, PDP, in the 2019 general election, Alhaji Atiku Abubakar, can serve President Muhammadu Buhari, through substituted means, copies of the petition challenging his victory at the February 23 elections.
The authority to do so was granted by the Presidential Election Petition Tribunal on Wednesday.
Counsel to Atiku, Chris Uche, had sought the authority to that effect through an ex parte motion.
With the motion granted, Buhari can be served the petition through any senior official or any official of the All Progressives Congress, APC, at its secretariat.
Justice Abdu Aboki who led the three man panel declared: “Leave is hereby granted to the applicants to serve the second respondent to the petition (Buhari), through any senior official or an officer of the APC at the party’s secretariat in Abuja.”
He added that the motion was granted in the interest of justice.
Atiku is challenging the victory of Buhari at the March 9 presidential election.
He had claimed that the election was fraught with irregularities and that the result was tampered with.
He claimed winning the election and sought that he, and not Buhari, should be declared the president by the Independent National Electoral Commission.
