Mr. Omoyele Sowore, has sought the leave of the court to vacate the court order granted for his detention for 45 days by the Department of State Services, DSS.
Sowore was the presidential candidate of the African Action Congress, AAC, in the last general election, and publisher of SaharaReporter, an online publication.
Sowore has been held for being the arrowhead of a protest titled Revolution Now said to be designed to seize power from the present government over bad governance.
On Thursday, the DSS applied for the order of the court to continue to hold Sowore who was accused of involvement in terrorism act through the Revolution Now protest.
The order was granted by Justice Taiwo Taiwo had.
But in a motion filed by his lawyer, Mr. Femi Falana, Sowore has sought the order of the Court of Appeal to direct that the order granted for his detention should be vacated.
He also sought that he should be discharged of all the allegations against him.
He argued that his detention was in violation of his human rights.
He argued too that it was a violation of the rules of the court.
Revolution Now scheduled for Monday, August 5, 2019 was quashed by security agencies who barricaded the National Stadium, venue of the take off of the protest, and dispersed those who had gathered for the event.
President Muhammadu Buhari had issued a statement to commend Nigerian for ignoring the call on the social media to join the protest.
