Prince Dayo Adeyeye has described as an anomaly, the issuance of Certificate of Return to Senator Biodun Olujimi as the representative of Ekiti South Senatorial District by the Independent National Electoral Commission, INEC.
He made the remark just as he complained that nine days after judgement was delivered by the Appeal Court led by Justice Ndukwe Anyanwu, against him, the court was yet to make copies of the judgement available to him despite repeated efforts.
INEC issued the certificate to Olujimi on Tuesday following the judgement of the Appeal Court which declared her as being the true winner of the senatorial seat.
Olujimi is of the Peoples Democratic Party, PDP, while Adeyeye is of the All Progressives Congress, APC.
INEC had declared Adeyeye as the winner of the election, but the victory was upturned by the election petition tribunal following Olujimi’s complaint that the election was fraught with irregularities.
The Appeal Court which Adeyeye approached to challenge the verdict upheld the decision of the tribunal.
But faulting INEC, Adeyeye said it was wrong to have issued the certificate when the judgement was said not to be ready.
Adeyeye’s position was made known on Thursday in a statement issued by his legal aide, Mr Tunde Bamigboye.
The statement reads in part: “It is very dismaying that despite the fact that the judgement is said not to be ready yet a certificate of judgement had been issued to our opponent in the case on the basis of which she was issued a certificate of return by INEC. What an anomaly!”
Adeyeye appealed to authorities of the court to prevail on the justices to live up to their constitutional responsibilities.
“If anything we deserve to know the basis of the judgement for our record and for posterity,” he said.
