A three man panel of the Court of Appeal on Wednesday compelled the Independent National Electoral Commission, INEC, to allow the Peoples Democratic Party, PDP, access to electoral materials used in the presidential election.
The order followed an ex-parte motion filed to that effect by the PDP and its presidential candidate, Alhaji Atiku Abubakar.
The motion which was granted in part however did not grant the permission to scan or make photocopy of the documents as demanded by PDP.
PDP in its motion had filed a suit at the presidential election petition tribunal in Abuja over the victory of President Muhammadu Buhari at the election held on February 23, 2019.
Buhari of the All Progressives Congress, APC, was declared winner of the contest by the Independent National Electoral Commission, INEC.
He defeated Atiku.
PDP and its candidate have since rejected the verdict of INEC, saying that the election was fraught with irregularities.
In the suit filed by its counsel, Chris Uche, PDP sought the leave of the tribunal to enable it inspect the materials used for the election.
They include the voters register, the smart card reader machines and ballot papers.
PDP requested that INEC be compelled to allow it scan and make photocopies of the documents used in the election.
The requests were to make PDP point out the alleged electoral malpractices carried out during the election.
