The Federal High Court sitting in Abuja has ordered the trio of Senate President, Bukola Saraki; Senator Ben Murray-Bruce and Senator Dino Melaye to honour police invitation.
The police had invited them following the protest over the governorship election of Osun State held in 2018.
The protest was carried out on October 5, 2018.
Complaining that the election was fraught with irregularities, the senators led others to protest the emergence of the All Progressives Congress, APC, Gboyega Oyetola, as the winner of the election.
They complained that the election was rigged against the Peoples Democratic Party, PDP, candidate, Ademola Adeleke.
One of the places the protesting PDP chieftains marched to was the Police Headquarters in Abuja.
They were however prevented from entering.
The police complained that they wanted to force themselves into the headquarters and invited them for questioning.
The senators have however refused to honour the invitation.
They approached the court to restrain the police from arresting them.
Giving its verdict on Thursday, the court dismissed the suit by the senators as lacking in merit.
Justice Okon Abang said the court could not preclude the police from carrying out their duties.
“It is my view that the police invitation to the applicants is still valid and subsisting; the applicants shall respond or report to the police invitation without fail.
“It is how the police treats them upon their having honoured the application that would determine whether their fundamental rights was violated not before they honour the invitation,” Abang declared.
The court awarded a cost of N50,000 in favour of the police.
