										<content:encoded><![CDATA[<p>A Sabo-Yaba Magistrate Court, on Tuesday, discharged Abdulazeez Fashola, (alias Naira Marley) and his ally Samson Eletu (alias Samlarry) in connection with the death of a Nigerian artist, Ilerioluwa Alogba, (alias Mohbad).</p>
<p>The court said, instead, it was a Nurse, Feysayo Ogedengbe and Ayobami Sadiq that should be prosecuted for Mohbad’s death due to alleged recklessness and negligence.</p>
<p>The Magistrate, Mrs.  E. Kubeinje said the ruling was on the advice of the state’s Department of Public Prosecution, DPP, signed by one Dr. Babajide Martins.</p>
<p>The magistrate said the DPP had advised the court to strike out the names of Naira Marley, Sam Larry, Owodunni Ibrahim (alias Primeboy) and Mohbad’s manager, Babatunde Opere, for lack of evidence linking them to the death of Mohbad.</p>

<p>Kubeinje said that the DPP had a prima facie case of the offence of reckless and negligent acts, contrary to Section 251(e) of the Criminal Laws of Lagos State, 2015, against Ogedengbe and Sadiq, respectively.</p>
<p>She said that the court agreed that an unlawful assault was carried out by Naira Marley, Sam Larry, Opere, and Primeboy on Mohbad but the assault could not rise to the point of criminal responsibility in view of the deceased.</p>
<p>Kubeinje added that Mohbad had also previously withdrawn his complaint against Naira Marley, dated October 11, 2022, on assault, on the grounds that the matter had been settled amicably.</p>
<p>According to her, hence, the defendants had no case to answer.</p>
<p>The court, thereafter, ruled that Ogedengbe and Sadiq should be prosecuted for the offence of recklessness and negligence, which is contrary to Section 251(e) of the Criminal Laws of Lagos State, 2015.</p>
<p>She also ruled that Sam Larry, Naira Marley, Primeboy, and Babatunde respectively had no case to answer in view of the demise of the deceased.</p>
<p>Kubeinje said that the defendants should be released if still in custody.</p>
<p>The magistrate adjourned the case until March 24 for an update in view of the ruling.</p>

										<content:encoded><![CDATA[<p>An Ikeja Chief Magistrates’ Court, on Thursday, ordered the remand in custody of Waheed Ibrahim, 32, charged with allegedly defiling a four-year-old girl.</p>
<p>Ibrahim, a resident of Ibeju-Lekki, Lagos, appeared before Chief Magistrate E. Kubeinje on a one count of defilement.</p>
<p>The Chief Magistrate, who did not take the defendant’s plea, ordered his remand in a Correctional facility in Lagos.</p>
<p>Kubeinje subsequently adjourned the matter until November 5, pending legal advice from the Lagos State Director of Public Prosecutions, DPP.</p>
<p>Earlier, the Prosecutor, Insp John Iberedem, told the court that the defendant committed the offence against the girl on September 3, at 27, Adeba Street, Igbeju-Lekki, Lagos.</p>
<p>Iberedem said that Ibrahim defiled the four-year-old girl by inserting his finger into her vagina.</p>
<p>The prosecutor said the offence contravened Section 261 of the Criminal Law of Lagos State, 2015.</p>
<p>The section stipulates life imprisonment for anyone found guilty of sexually penetrating any opening in the body of another person, with a part of his body without permission of the person.</p>

										<content:encoded><![CDATA[<p>An Ikeja Chief Magistrates’ Court in Lagos State on Wednesday remanded a 39-year-old man, Chibuike Ajunwa, in Kirikiri Correctional Centre for allegedly defiling a seven-year-old girl.</p>
<p>Chief Magistrate E. Kubeinje, did not take the plea of Ajunwa, pending legal advice from the state Director of Public Prosecutions.</p>
<p>Kubeinje adjourned the case until April 17, for mention.</p>
<p>Earlier, the Prosecutor, SP Kehinde Ajayi, told the court that Ajunwa, who lives in Igando, Lagos defiled the seven-year-old girl.</p>
<p>The police said that the offence contravened the provisions of Section 27 and is punishable under Section 210(8) of the Child’s Right Law of Lagos State, 2015.</p>
<p>The defendant is liable to life imprisonment if found guilty of the offence.</p>

										<content:encoded><![CDATA[<p>A female teacher, Aderonke Makonde, was on Wednesday docked in an Ikeja Magistrates’ Court, Lagos for assaulting a nine-year-old pupil of the school.</p>
<p>The police charged Makonde, 35, a teacher at Westgate Land Emperial Creche Nursery and Primary School, Mushin, Lagos with assault.</p>
<p>The woman, however, pleaded not guilty to the charge.</p>
<p>The Prosecution Counsel, DSP Kehinde Ajayi, told the court that Makonde allegedly assaulted the pupil by “flogging her mercilessly all over her body with cane and causing her bodily harm”.</p>
<p>She said the pupil’s offence was noise making in class.</p>
<p>Ajayi said the teacher’s offence contravened the provisions of section 172 of the Criminal Law of Lagos, 2015.</p>
<p>The Chief Magistrate, Mrs E. Kubeinje, admitted the defendant to bail in the sum of N50,000 with two sureties each in like sum with proof of tax payment and verification of address.</p>
<p>Kubeinje later adjourned the matter to June 7 for hearing.</p>
