										<content:encoded><![CDATA[<p>The Department of State Services, DSS, on Thursday arraigned former governor of Kaduna State, Nasir El-Rufai for allegedly intercepting the telephone conversations of the National Security Adviser, NSA, Nuhu Ribadu.</p>
<p>El-Rufai, who was arraigned before Justice Joyce Abdulmalik of the Federal High Court in Abuja on a five-count further amended charge, pleaded not guilty to all the counts.</p>
<p>The charge is marked: FHC/ABJ/99/2026.</p>
<p>When the case was called, DSS lawyer, Oluwole Aladedoye, SAN, informed the court that the matter was fixed for the defendant to take his plea.</p>
<p>Aladedoye, however, told the court that a further amended five-count charge was filed on April 13.</p>
<p>The lawyer prayed the court to substitute it with the earlier three-count charge.</p>
<p>“We pray that the earlier charge be struck out my lord,” he said.</p>
<p>Responding, El-Rufai’s counsel, Oluwole Iyamu, SAN, said he had been served with the amended charge and that he was not opposing.</p>
<p>The judge then struck out the earlier three-count charge.</p>
<p>After the counts were read to the former governor, he pleaded not guilty and Aladedoye sought a three consecutive trial dates.</p>
<p>Iyamu, however, objected to an application for a three consecutive days for commencement of the trial.</p>
<p>He submitted that since the defendant had been in the custody of Independent Corrupt Practices and Other Related Offences Commission, ICPC, having access to him within the three days of the trial might be difficult.</p>
<p>According to him, the three days might not be in the defence’ best interest.</p>
<p>Iyamu also informed the court of their bail application filed on February 17.</p>
<p>However, the further affidavit in support of the bail application was not in the court file and the judge stood down the matter for Iyamu to do the needful.</p>
<p>Upon resumed hearing, Iyamu moved the bail application and urged the court to grant their prayers.</p>
<p>Aladedoye did not oppose the bail request.</p>
<p>But he prayed the court to set conditions that would ensure that the defendant presents himself for trial.</p>
<p>Aladedoye proceeded to also move a motion seeking an order to conceal the identities of two of the five witnesses to be called by the prosecution.</p>
<p>He said the prosecution desired that the identities of the two witnesses should not appear in public or court records and they should be identified with pseudonyms during trial.</p>
<p>Aladedoye said the application was informed by the belief that should their identities be revealed, the said witnesses, who are officials of the DSS, and members of their families would be exposed to danger and could be attacked by persons sympathetic to the defendant.</p>
<p>Iyamu objected to the application and argued that it was the constitutional right of a defendant to know his accusers.</p>
<p>He further submitted that there was no evidence before the court showing that El-Rufai had any cult-like followership or posed a threat.</p>
<p>The defence lawyer said the defendant had dedicated his life to public service and warned that granting a blanket anonymity order could create serious prejudice against the defendant.</p>
<p>Iyamu also moved an application in which he is praying for an order directing the prosecution to furnish the defence with proof of evidence to prepare for trial, an application Aladedoye also opposed.</p>
<p>Aladedoye argued that the materials sought by the defence were documents unrelated to the processes filed by the prosecution.</p>
<p>El-Rufai’s lawyer also moved another application in which the defendant is praying for the quashing of the charge.</p>
<p>Aladedoye, however, objected to the request, arguing that the application lacked merit.</p>
<p>He urged the court to dismiss the application in its entirety.</p>
<p>Ruling, Justice Abdulmalik issued an order for accelerated hearing of the case and adjourned the matter until May 18, May 19 and May 20 for ruling on all pending applications and for the prosecution to open its trial.</p>
<p>The judge also ordered that the defendant, who was brought from the custody of ICPC in relation to a separate case, should be remanded in the custody of the DSS.</p>
<p>She ordered that the defence lawyers should comply with the operating procedure of the DSS and that the officials of the DSS should cooperate with the defence lawyers to enable them prepare his defence.</p>
<p>However, after the judge made the order, Iyamu called the attention of the court to the fact that El-Rufai was brought from the ICPC’s custody.</p>
<p>The lawyer, who told the court that the ex-governor was in the anti-corruption commission’s detention on the order of two Kaduna courts, expressed their frustration.</p>
<p>Responding, Justice Abdulmalik held that it is the practice that all institutions confer among one another to sort out contentious issues.</p>
<p>She said since the DSS was the prosecution before her, she could only direct the secret police to afford the defendant necessary facilities to meet with his lawyers.</p>
<p>“I don’t have to read social media to determine my case.</p>
<p>“So I want the journalists here to quote me correctly.</p>
<p>“I use the matters before my court to determine my cases,” the judge said.</p>
<p>In count one the ex-governor was alleged to have intentionally and unlawfully interfered with the communication of the NSA, Mr Ribadu, which constitutes Critical National Information Infrastructure, CNII.</p>
<p>It said that was contained in Designation and Protection of Critical National Information Infrastructure Order, 2024 gazetted as Statutory Instrument No. 21 of 2024, as admitted by El-Rufai on February 13, while appearing as a guest on <em>Arise TV</em> Station’s Prime Time Programme in Abuja.</p>
<p>The offence is contrary to Paragraph 7 (b) &amp; (c) of the Designation and Protection of Critical National Information Infrastructure Order, 2024 and punishable under Section 5 (1) of the Cybercrimes (Prohibition, Prevention, etc) Amendment Act, 2024.</p>

										<content:encoded><![CDATA[<p>A celebrated Canadian-Nigerian broadcaster, Samuel Osaze Iyamu, has released a landmark memoir chronicling decades of journalism at the intersection of power, conflict, and culture across Africa.</p>
<p>Titled <em>Not to Be Broadcast</em>, the book—published recently and now available globally—offers a sweeping account of Iyamu’s more than 35-year career in national and international broadcasting, alongside a deeply personal reflection on the forces that shaped modern African media.</p>
<p>From his early education at Edo College in Benin City to an unexpected entry into broadcasting after abandoned studies in the United Kingdom, Iyamu’s journey spans some of Nigeria’s most influential media institutions, including the Voice of Nigeria and the Federal Radio Corporation of Nigeria.</p>
<p>The memoir goes beyond a personal narrative, offering what observers describe as a rare insider account of broadcasting in Nigeria and West Africa during periods of political upheaval and military rule.</p>
<p>One of its central themes is the role of media power in shaping legitimacy, captured in Iyamu’s assertion that control of the airwaves often outweighed constitutional authority.</p>
<p>The book opens dramatically with a near-fatal shooting incident in Lagos in 2001, when Iyamu was caught in an altercation with soldiers during a fuel scarcity crisis—an episode he uses to illustrate the risks of challenging authority in a militarised environment.</p>

<p>As Chief News Producer at the Voice of Nigeria, Iyamu recounts coordinating coverage of the Liberian Civil War and the Sierra Leone Civil War, including interviews with ECOMOG commanders and political figures conducted under difficult conditions.</p>
<p>He also revisits the tense newsroom atmosphere following the sudden death of Nigeria’s former military ruler, Sani Abacha, in 1998—a moment handled under intense national and international scrutiny.</p>
<p>Beyond politics and conflict, <em>Not to Be Broadcast</em> explores Africa’s cultural memory.</p>
<p>Iyamu dedicates significant attention to his acclaimed radio documentary series <em>Highlife My Life</em>, a years-long effort to preserve West Africa’s musical heritage. A key highlight is his search for legendary musician Ambrose Campbell, culminating in a filmed interview in England widely regarded as an important archival contribution.</p>
<p>The latter part of the memoir addresses themes of institutional betrayal, professional exile, and migration to Canada, as well as the quieter aftermath of a life spent in the public eye. Despite these challenges, Iyamu closes on a note of resolve, arguing that stories once deemed unfit for broadcast must still be preserved and told.</p>

										<content:encoded><![CDATA[<p>The rights enforcement suit by former governor of Kaduna State, Nasir El-Rufai, against the Independent Corrupt Practices and other related offences Commission, ICPC, and four others suffered a setback on Tuesday over the inability of his lawyer to serve the respondents.</p>
<p>El-Rufai is demanding a N1 billion in damages against ICPC (1st respondent) and others.</p>
<p>They include the Chief Magistrate at the Magistrate’s Court of the FCT, Abuja; Inspector-General (I-G) of Police and the Attorney-General of the Federation (AGF), named as 2nd to 4th respondents respectively.</p>
<p>The matter, which was before Justice Joyce Abdulmalik of the Federal High Court in Abuja, could not proceed shortly after it was called.</p>
<p>Upon resumed hearing, only Ubong Akpan, the counsel, who appeared for the ex-govenor, was in court, as there was no representation for the respondents.</p>
<p>Akpan, therefore, informed the court that though the matter was scheduled for mention, they had been unable to serve the respondents.</p>
<p>He sought an adjournment to enable them do the needful and Justice Abdulmalik fixed March 11 for further mention.</p>
<p>El-Rufai, through his team of lawyers led by Oluwole Iyamu, SAN, is praying the court to declare that the search warrant issued on February 4 by the Chief Magistrate, Magistrate’s Court of the FCT (2nd respondent), authorising the search and seizure at his residence was invalid, null and void.</p>
<p>He is asking the court to declare that the search warrant is “null and void for lack of particularity, material drafting errors, ambiguity in execution parameters, overbreadth, and absence of probable cause thereby constituting an unlawful and unreasonable search in violation of Section 37 of the Constitution.”</p>
<p>The former governor, in the originating motion on notice marked: FHC/ABJ/CS/345/2026, dated and filed February 20 by Iyamu, sought seven reliefs.</p>
<p>He prayed the court to declare that the invasion and search of his residence at House 12, Mambilla Street, Aso Drive, Abuja, on February 19 at about 2pm by the ICPC and I-G, a gross violation of the applicant’s fundamental rights.</p>
<p>He said that it was violation to dignity of the human person, personal liberty, fair hearing, and privacy under Sections 34, 35, 36, and 37 of the Constitution.</p>
<p>He urged the court to declare that “any evidence obtained pursuant to the aforesaid invalid warrant and unlawful search is inadmissible in any proceedings against the applicant, as it was procured in breach of constitutional safeguards.”</p>
<p>El-Rufai, therefore, sought an order of injunction restraining the respondents and their agents from further relying on, using, or tendering any evidence or items seized during the unlawful search in any investigation, prosecution, or proceedings involving him.</p>
<p>He sought an order directing the 1st and 3rd respondents (ICPC and I-G) to forthwith return all items seized from the applicant’s premises during the unlawful search, together with a detailed inventory thereof.</p>
<p>He also sought an order awarding the sum of N1 billion as general, exemplary, and aggravated damages.</p>
<p>El-Rufai did the breakdown of the N1 billion in damages to include “a N300 million as compensatory damages for psychological trauma, emotional distress, and loss of personal security;</p>
<p>“N400 million as exemplary damages to deter future misconduct by law enforcement agencies and vindicate the applicant’s rights.</p>

<p>In his grounds of argument, the senior lawyer argued that the search warrant was fundamentally defective, lacking specificity in the description of items to be seized, containing material typographical errors, ambiguous execution terms, overbroad directives, and no verifiable probable cause.</p>
<p>He said that was in contravention of Sections 143-148 of the Administration of Criminal Justice Act (ACJA), 2015; Section 36 of the Corrupt Practices and Other Related Offences (ICPC) Act, 2000, and constitutional protections against arbitrary intrusions.</p>
<p>Specifically, Iyamu argued that Section 143 of the ACJA required that an application for a search warrant be supported by information in writing and on oath, setting forth reasonable grounds for suspicion, which was absent here as evidenced by the incomplete initiating clause.</p>
<p>He said Section 144 mandated particular descriptions of the place to be searched and the items sought, to prevent general warrants.</p>
<p>He, however, argued that the instant warrant vaguely referred to “the thing aforesaid” without any detail.</p>
<p>Iyamu stated that the execution of the invalid warrant on February 19 resulted in an unlawful invasion of his client’s premises, constituting violations of the rights to dignity (Section 34), personal liberty (Section 35), fair hearing (Section 36), and privacy (Section 37) of the Constitution.</p>
<p>He further argued that the search was conducted without legal justification and in a manner that inflicted humiliation and distress.</p>

										<content:encoded><![CDATA[<p>Former governor of Kaduna State, Nasir El-Rufai, has prayed the Federal High Court in Abuja for an order restraining the Independent Corrupt Practices and Other Related Offences Commission, ICPC, and others from taking any step to freeze his bank accounts or seize his property.</p>
<p>El-Rufai, in a fresh suit filed by his lawyer, Oluwole Iyamu, SAN, urged the court for an order of interim injunction directing the respondents to maintain the status quo ante pending the hearing and determination of the application and the substantive originating motion.</p>
<p>The ex-governor said the order was necessary to prevent a fait accompli as recognised in previous cases.</p>
<p>Besides the ICPC, which is named as 1st respondent, others joined in the suit are the Economic and Financial Crimes Commission, EFCC; Department of State Services, DSS, and Attorney-General of the Federation, AGF, as 2nd to 4th respondents respectively.</p>
<p>In the originating process marked FHC/ABJ/CS/368/2026 dated February 23 but filed February 24 by Iyamu, the former Kaduna State governor sought eight reliefs.</p>
<p>El-Rufai is praying for a declaration that his severance pay, received upon the completion of his tenure as governor of Kaduna State between 2015 and 2023, could not reasonably be suspected to be proceeds of any unlawful activity.</p>
<p>He sought “a declaration that the properties purchased by the applicant from his said severance pay were lawfully acquired and owned by him.”</p>
<p>He listed the banks to include Zenith Bank Plc, Naira Account Number: 1007158671; Zenith Bank Pic, Domiciliary Account Number: 507 1511327; Guaranty Trust Bank (GTB) Plc (GTB), Account Number: 0023824978; Access Bank, Dollar Account Number: 1396386493 and Access Bank, Naira Account Number: 1396382103.</p>
<p>He also sought a declaration that any attempt or plan by the respondents or their agents to apply for, obtain or execute any interim or final forfeiture order, freezing order, seizure order, or any other order depriving him of his property and/or bank accounts, without first establishing a reasonable suspicion supported by credible evidence as required by relevant law would amount to a breach of his rights.</p>
<p>He cited the law as Section 17(1) of the Advance Fee Fraud and Other Related Offences Act, 2006 and the Supreme Court decision in Melrose General Services Ltd v. EFCC (2024) SC/1519/2019.</p>
<p>El-Rufai prayed the court to declare that, as a citizen of Nigeria, he is entitled to the presumption of innocence and the protection of his fundamental rights.</p>
<p>He said that any action by the respondents that sought to circumvent those rights by way of ex-parte applications that concealed material facts would amount to a breach of Section 36(5) of the constitution and a violation of the principles of fair hearing.</p>
<p>The ex-governor, therefore, sought an order of perpetual injunction restraining the respondents from taking any step whatsoever to freeze, attach, seize, forfeit, or otherwise interfere with his said property and bank accounts.</p>
<p>He sought an order awarding the sum of N1 billion “as general, exemplary, and aggravated damages against the respondents jointly and severally for:</p>
<p>“The anticipated violation of the applicant’s fundamental rights;</p>
<p>“The psychological trauma, distress, anxiety, and reputational harm caused by the threat of unlawful forfeiture proceedings;</p>
<p>“The need to deter the respondents and other agencies from engaging in similar overreach, abuse of power, and disregard for constitutional safeguards.”</p>
<p>He equally sought an order awarding the sum of N100 million as costs of the action against the respondents, including legal fees and associated expenses.</p>
<p>El-Rufai, in his grounds for the application, said he “is a citizen of Nigeria and a former high-ranking public officer who served as Chief Executive of Nigeria’s Federal Privatisation Agency (1999-2003), Minister of the Federal Capital Territory, Abuja (2003-2007), and Governor of Kaduna State (2015-2023).”</p>
<p>He said he had never been convicted of any criminal offence and had repeatedly challenged anyone to come forward with evidence of wrongdoing, which challenge had gone unanswered.</p>
<p>He said upon the completion of his tenure as Governor of Kaduna State, he became entitled to, and received, severance pay calculated at 300 per cent of his annual basic salary pursuant to the RMAFC guidelines and the applicable laws of Kaduna State.</p>
<p>He specifically gave the state’s law as the Pension and Gratuity (Governor and Deputy Governor) Law 2006 (as amended in 2013 and 2020).</p>
<p>“This severance pay is a lawful entitlement, not proceeds of unlawful activity,” he said.</p>
<p>According to him, the applicant has legitimately applied for his said severance pay and other lawful earnings to acquire properties and maintain bank accounts, including the accounts specified in Relief 2 above with Zenith Bank Plc, GTB and Access Bank Pic.</p>
<p>“The ICPC concluded, without regard to applicable law or documentary facts, that the severance package is unlawful,” he said.</p>
<p>He said the AGF (4th respondent), being the Chief Law Officer of the Federation and the officer charged with superintendence over all prosecutorial and asset recovery activities of the Federal Government, was a necessary party to the proceedings to ensure that any order made by the court was binding on the Federal Government as a whole.</p>
<p>He, therefore, stated that any of such intended action by the respondents would be baseless and lacking in reasonable suspicion, as the severance pay in question was a lawful entitlement and there existed no credible evidence linking his property or accounts to any unlawful activity.</p>
<p>He said he had no other adequate remedy to prevent the threatened violation of his rights if the respondents were not restrained.</p>
<p>“The applicant has come to this court with clean hands, has nothing to hide and is ready and willing to cooperate with any lawful investigation conducted in accordance with due process,” he said.</p>

										<content:encoded><![CDATA[<p>Former governor of kaduna State, Nasir El-Rufai, has filed a N1 billion fundamental rights enforcement suit against the Independent Corrupt Practices and other related offences Commission, ICPC, over alleged unlawful invasion of his Abuja residence.</p>
<p>El-Rufai, through his team of lawyers led by Oluwole Iyamu, SAN, prayed the court to declare that the search warrant issued on February 4 by the Chief Magistrate, Magistrate’s Court of the FCT (2nd respondent), authorising the search and seizure at his residence was invalid, null and void.</p>
<p>He urged the court to declare that the search warrant was “null and void for lack of particularity, material drafting errors, ambiguity in execution parameters, over breadth, and absence of probable cause thereby constituting an unlawful and unreasonable search in violation of Section 37 of the Constitution.”</p>
<p>The former governor had, in the originating motion on notice marked: FHC/ABJ/CS/345/2026, sued ICPC as 1st respondent.</p>
<p>El-Rufai named the Chief Magistrate, Magistrate’s Court of the FCT, Abuja Magisterial District; I-G and Attorney-General of the Federation (AGF) as 2nd to 4th respondents respectively.</p>
<p>In the suit dated and filed February 20 by Iyamu, the detained ex-governor sought seven reliefs.</p>
<p>He prayed the court to declare that the invasion and search of his residence at House 12, Mambilla Street, Aso Drive, Abuja, on February 19 at about 2 p.m. and executed by agents of ICPC and I-G, “under the aforesaid invalid warrant, amounts to a gross violation of the applicant’s fundamental rights to dignity of the human person, personal liberty, fair hearing, and privacy under Sections 34, 35, 36, and 37 of the Constitution.”</p>
<p>He urged the court to declare that “any evidence obtained pursuant to the aforesaid invalid warrant and unlawful search is inadmissible in any proceedings against the applicant, as it was procured in breach of constitutional safeguards.”</p>
<p>El-Rufai, therefore, sought an order of injunction restraining the respondents and their agents from further relying on, using, or tendering any evidence or items seized during the unlawful search in any investigation, prosecution, or proceedings involving him.</p>
<p>“An order directing the Ist and 3rd respondents (ICPC and I-G) to forthwith return all items seized from the applicant’s premises during the unlawful search, together with a detailed inventory thereof.</p>
<p>“An order awarding the sum of N1,000,000,000.00 (One Billion Naira) as general, exemplary, and aggravated damages against the respondents jointly and severally for the violations of the applicant’s fundamental rights, including trespass, unlawful seizure, and the resultant psychological trauma, humiliation, distress, infringement of privacy, and reputational harm.”</p>
<p>El-Rufai did the breakdown of the N1 billion in damages to include: “A N300 million as compensatory damages for psychological trauma, emotional distress, and loss of personal security; N400 million as exemplary damages to deter future misconduct by law enforcement agencies and vindicate the applicant’s rights; N300 million as aggravated damages for the malicious, high-handed and oppressive nature of the respondents’ actions, including the use of a patently defective warrant procured through misleading representations.”</p>

<p>“Section 146 stipulates that the warrant must be in the prescribed form, free from defects that could mislead, but the document is riddled with errors in the address, date, and district designation;</p>
<p>“Section 147 allows direction to specified persons, but the warrant’s indiscriminate addressing to all officers is overbroad and unaccountable.</p>
<p>“Section 148 permits execution at reasonable times, but the contradictory language creates ambiguity, undermining procedural clarity,” he submitted.</p>
<p>Iyamu stated that the execution of the invalid warrant on February 19 resulted in an unlawful invasion of his client’s premises, constituting violations of the rights to dignity (Section 34), personal liberty (Section 35), fair hearing (Section 36), and privacy (Section 37) of the Constitution.</p>
<p>He further argued that the search was conducted without legal justification and in a manner that inflicted humiliation and distress.</p>
<p>“Evidence obtained without a valid warrant is unlawful and inadmissible, as established in judicial precedents such as C.O.P. v. Omoh (1969) NCLR 137, where the court ruled that evidence procured through improper means contravenes fundamental rights and must be excluded,” he said.</p>
<p>The lawyer, who also cited the case of Fawehinmi v. IGP (2000) 7 NWLR (Pt. 665) 481, said the court condemned vague warrants as affording unbridled discretion and leading to abuse.</p>
<p>He equally gave a plethora of cases to back his argument.</p>
<p>In the affidavit in support of the application, Mohammed Shaba, a Principal Secretary to the former governor, averred that on February 19 at about 2 p.m., officers from the ICPC and Nigeria Police Force invaded the residence under a purported search warrant issued on or about February 4.</p>
<p>According to him, the said warrant is invalid due to its lack of specificity, errors, and other defects as outlined in the grounds of this application.</p>
<p>He said the “search warrant did not specify the properties or items being searched for.”</p>
<p>Shaba stated that the officers failed to submit themselves for search as provided by the law before proceeding with the search.</p>
<p>“That the Magistrate did not specify the magisterial district wherein he sits.</p>
<p>“That during the invasion, the officers searched the applicant’s premises without lawful authority, seized personal items including documents and electronic devices, and caused the applicant undue humiliation, psychological trauma, and distress.</p>
<p>“Now shown to me and marked as ‘EXHIBIT B’ Is the list of the items carted away.</p>
<p>“That no items seized have been returned, and the respondents continue to rely on the unlawful evidence.</p>
<p>“That the applicant suffered violations of his constitutional rights as a result, and this application is brought in good faith to enforce same,” Shaba said.</p>
