The Inspector-General, I-G, of Police, on Thursday, re-arraigned controversial social media influencer, Martins Otse, popularly called VeryDarkMan, VDM, for allegedly cyberbullying actresses Iyabo Ojo and Tonto Dikeh.

VDM was also alleged to have cyberbullied famous Nigerian producer and singer, Samuel Oguachuba, also known as Samklef, among others.

He was re-arraigned before Justice Musa Liman of the Federal High Court in Abuja on five-count charge.

He, however, pleaded not guilty to the charge.

His lawyer, Deji Adeyanju, prayed the court to allow VDM to continue on the earlier bail granted by Justice Mobolaji Olajuwon of a sister court.

Counsel to the I-G, Victor Okoye, did not object and the judge admitted him to the earlier bail terms and adjourned the matter until July 24 for trial.

VDM had, on May 22, 2024, arraigned before Justice Olajuwon on same offences contrary to and punishable under Section 24 of the Cybercrime (Prohibition, Prevention, etc) Act, 2015.

He was remanded and granted a N10 million bail on June 10, 2024, by the judge with two sureties who must be employee of reputable company or Level 17 officers in a federal civil service with evidence of three years’ tax clearance.

The charge, marked: FHC/ABJ/CR/140/2024 dated and filed on March 28, 2024, was, however, re-assigned to Justice Liman, following Justice Olajuwon’s transfer to another division of the Federal High Court.

In count one, VDM was alleged to have on or about October 13, 2023, intentionally published via a video posted on his Instagram handle ‘verydarkblackman’, (aka verydarkblackman) threatening and bullying words, to harass Samuel Oguachuba.

In count two, he was alleged to have, on or about October 29, 2023, intentionally posted videos, by means of computer system on his Instagram handles which contained information that was grossly offensive, pornographic or of an indecent, obscene or menacing character against Iyabo Ojo.

In the video, he was alleged to have stated that “one Iyabo Ojo is having indecent sexual relationship with her daughter.”

VDM was also accused to have, on or about January 19, 2024, knowingly posted videos on his Instagram handles where he “falsely published that King Tonto Dikeh is accused of criminal conversion of the proceeds of crowd funding for Justice for Mohbad Movement, and being the person behind the gistlover blog.”

In count four, the defendant was alleged to have intentionally posted videos on March 19, 2024, on his Instagram handle against the Deputy-Inspector Generals, DIGs, of Police and lawmakers in the National Assembly considered to be annoying and insulting.

State counsel, Mr Yusuf Sule, made the disclosure on Friday while explaining the absence of two witnesses slated to testify against the actor in his ongoing trial for sexual assault.

“My lord, the first witness is a police officer, he could not come to court today because he has been transferred and needs to get permission from where he was posted.

“The second witness could not come to court; he is jittery, he is scared to come to court.

“My lord, we will ensure that all the witnesses are in court by next week Friday,” the prosecutor said.

Lagos State Directorate of Public Prosecution, DPP, says it will prosecute a Nollywood actor, Yomi Fabiyi, for contempt of court over the airing of a movie about the facts of a case under judicial consideration.

The Lagos State Director of Public Prosecution, Mrs Olayinka Adeyemi, on Monday told an Ikeja Special Offences Court that Fabiyi produced a movie entitled “Oko Iyabo,” based on the court proceedings of June 24, 2021.

Nollywood actor, Olanrewaju James, alias ‘Baba Ijesha’ is facing a six-count charge bordering on the indecent treatment of a child, sexual assault, attempted sexual assault by penetration and sexual assault by penetration at the court.

Adeyemi told the court on Monday that despite warnings during proceedings of June 24 that the matter was subjudice and, therefore, prohibited from public discussion elsewhere, Fabiyi went ahead and made a movie about the facts of the case.

The DPP noted that the movie, which was aired after the proceedings of June 24, breached the Judge’s directives by revealing sensitive information about the case which was before the court.

“Despite the warnings of this honourable court, an actor called Yomi Fabiyi went ahead and made a movie about the facts of this case.

“He used real names of the parties and witnesses in this matter in the movie. Our application is to exclude him, his privies and his agents from proceedings in court.

“He is not in court at the moment but his representatives may be in court. This is contempt of court and we intend to prosecute him and bring him before this court,” the DPP said.

Reacting, Justice Oluwatoyin Taiwo expressed displeasure about the development and ordered for an investigation.

“This case is subjudice and you are not to be making videos and disparaging comments on social media. This needs to be investigated,” the judge said.

Responding to the allegations, the lead defence counsel, Mr Dada Awosika (SAN), said that though he was aware of the movie, it was filmed before the criminal case began in court.

“The movie is about the controversy between two artistes – Yomi Fabiyi and Iyabo Ojo. I saw the movie on YouTube.

“The two of them are supporters on different sides. Fabiyi is one supporter and Ojo is another supporter.

“This movie is about the controversy between both of them and they are not parties to this case,” Awosika said.

Justice Taiwo reiterated the fact that the allegations against Fabiyi should be investigated by authorities to enable legal actions to be taken against him if he is found culpable.

Famous Nollywood actress, Ms Iyabo Ojo, was in court during the proceedings.

The Nollywood actress and the foster mother of the complainant, Ms Damilola Adekoya, alias Princess, had begun their testimonies as witnesses for the state.

The Police Command in Lagos State has debunked the rumours that there were plans to release Nollywood actor, Baba Ijesha, who was arrested for alleged defilement.

It was gathered that Nollywood actress, Iyabo Ojo, comedian, Princess, and others had stormed the SCID, Panti, to protest alleged plans to release Baba Ijesha by the police.

The Police Public Relations Officer, PPRO, in Lagos, CSP Olumuyiwa Adejobi, said there were no plans to release the suspect as wrongly perceived.

He added that the Commissioner of Police in Lagos State, CP Hakeem Odumosu, had ordered the detention of the suspect pending the receipt of legal advice from the Directorate of Public Prosecutions (DPPs).

“The CP had already said that the suspect would remain in police custody and would not be released. His case file has been sent to the DPP for advice. After the DPP’s advice, we will know what to do,” he said.

The 48-year-old Olarenwaju James, popularly known as Baba Ijesha, was arrested on April 22 for allegedly defiling a minor.

CSP Olumuyiwa Adejobi had said in a statement that preliminary findings revealed that the suspect started assaulting the victim sexually since she was seven years’ old.

There was an uproar following a report that a directive had been given for the release of the Nollywood actor from custody.

The report was that the suspect could be released as he could not be detained indefinitely due to the ongoing strike by members of the Judicial Staff Union of Nigeria, JUSUN.

A video of the suspect confessing to the crime and begging for forgiveness had, however, gone viral following the rumour that investigation allegedly revealed that Baba Ijesha did not defile the victim.
