										<content:encoded><![CDATA[<p>Hope Democratic Party has sought the order of the Presidential Election Tribunal to restrain President Muhammadu Buhari from being sworn in on May 29, 2019.</p>
<p>The party filed a motion to that effect on May 9, 2019.</p>
<p>In the same vein, it sought an order to restrain the Chief Justice of Nigeria from swearing-in, administering the oath of office and oath of allegiance to the president on May 29, 2019.</p>
<p>The reasons for the position of the party are contained in the motion.</p>
<p>The motion, it said, was pursuant to Section 1, Sub-section 2 of the 1999 constitution as amended and under the jurisdiction of the tribunal.</p>
<p>The party argued that there was a petition still pending which was challenging the victory of the president during the last election.</p>
<p>The petition, the party said, had been served on the president and pleadings had been exchanged.</p>
<p>According to Hope Democratic Party, the preparations for the inauguration was despite the legal action over his victory.</p>
<p>It argued that it would be against the law to swear in the president since the validity of his election into office was still being challenged.</p>
<p>Respondents in the case include Buhari, the All Progressives Congress, APC, and the Independent National Electoral Commission, INEC.</p>
