The Supreme Court on Thursday, dismissed the decision of the Court of Appeal, ordering parties to maintain status quo antebellum, in the leadership dispute within the ADC.

The apex court however maintained that the appellate court was right in ordering parties to return to the Federal High Court where party leadership tussle existed.

On the issue of jurisdiction, the court faulted the appellant noting that the apex court had the jurisdiction to entertain appeals from the lower court, citing section 233 of the 1999 constitution.

It ordered parties in the African Democratic Congress, ADC, leadership tussle to return to the Federal High Court for the resolution of the matter.

In its unanimous judgment it set aside the order of the Court of Appeal, which ordered parties in the suit to maintain status quo ante bellum.

Justice Mohammed Garba, who delivered the lead judgment held that the lower court was wrong to have raised the issue “somoto” (on its own, not requested by any party in the matter), and subsequently issued the status quo ante bellum order.

According to the judgment, it was wrong for the lower court to issue any preservative order in a case pending before the trial court.

“The directive made (status quo ante bellum) after striking out the appeal and issuing an accelerated hearing was unnecessary, unwarranted and improper,” Garba held.

The ex-Senate President, David Mark, had asked the court to grant an order staying the execution of the Court of Appeal’s ruling delivered on March 12 that dismissed his appeal in relation to the ongoing leadership dispute in the party.

A three-member panel of the Court of Appeal, led by Justice Uchechukwu Onyemenam had upheld the objection raised by Bala insisting that the appeal was incompetent and that it was based on issues not reflected in the ruling of the trial court.

Mark had appealed a September 4, 2025 ruling by Justice Emeka Nwite of the Federal High Court in Abuja that refused to grant some injunctive reliefs contained in an ex-parte application filed by Bala.

The dispute, which began as an internal transition disagreement in mid-2025, has now drawn in the courts and INEC, raising concerns over the ADC’s capacity to function as a viable opposition platform ahead of the 2027 general elections.

INEC’s decision on April 1, to withdraw recognition from both the Mark- and Bala-led factions, citing a subsisting Court of Appeal order to maintain the status quo ante bellum, has left the party without an officially recognised leadership structure.

The electoral body said it would not engage with any faction pending a final judicial determination, a position that could have far-reaching implications for the party’s participation in the 2027 polls.

The Mark-led faction insisted it emerged through due process, citing a series of National Executive Committee (NEC) decisions in 2025, including the July 29 ratification of a caretaker leadership.

Relying on provisions of Article 13 of the ADC constitution, the group argued that the NEC was empowered to administer the party, implement convention decisions and establish interim structures where necessary.

It also cited Articles 17(3) and 17(4) to justify the transition process, maintaining that vacancies were properly filled through the appropriate executive mechanisms.

On eligibility, the faction contended that requirements such as the two-year membership rule under Article 9(4) were lawfully waived through NEC resolutions earlier in 2025 to accommodate coalition-building efforts.

It further argued that its initial recognition by INEC in September 2025, alongside its conduct of congresses and the April 14, National Convention, affirmed its legitimacy.

The Supreme Court has fixed April 22 to hear two separate appeals filed by the Kabiru Turaki-led faction of the Peoples Democratic Party, PDP.

The faction is seeking to overturn the Court of Appeal’s decision invalidating the Ibadan national convention held on November 15 and 16, 2025.

‎‎A five-member panel of the apex court, led by Justice Lawal Garba, granted the Turaki faction’s application for accelerated hearing and departure from the rules to abridge the time for filing briefs of argument.

‎‎In the first appeal, filed by the Turaki-led group against the PDP faction loyal to Federal Capital Territory, FCT, Minister, Nyesom Wike, the court ordered that hearing notices be served on Mohammed Abdulrahman, the seventh respondent, who was not represented when the matter came up on Tuesday.

‎‎At the proceedings, Chris Uche (SAN), counsel to the Turaki faction, informed the court of the pending applications, stressing the need for urgency to align with the Independent National Electoral Commission, INEC, timetable ahead of the 2027 general elections.

He also filed an affidavit of extreme urgency.

‎‎Counsel to Austin Nwachukwu and two others, Emmanuel Ukala (SAN), requested 15 days to file his reply, citing the need to obtain all relevant court records from the Court of Appeal’s decision nullifying the Ibadan convention.

‎‎The supreme court, however, directed all nine respondents to file their replies within five days each and fixed April 22, 2026, for the hearing of the appeal.

‎‎In the second appeal, involving the Turaki-led faction against former Jigawa Governor Sule Lamido and others, the apex court also granted accelerated hearing and abridgement of time, and fixed April 22 for hearing.

‎‎Lamido had sued over his exclusion from the national chairmanship contest, which led to Justice Peter Lifu of the Federal High Court issuing orders halting the convention.

‎‎Lower courts (Federal High Court and Court of Appeal) have largely ruled against the Turaki faction, nullifying the Ibadan convention, barring INEC from recognising its outcomes, and restricting access to the national secretariat in some rulings.

‎The Turaki group has appealed to the apex court, arguing that the matter bordered on internal party affairs, which were not justiciable, and that due procedures were followed.

In October 2025, the Federal High Court in Abuja stopped the PDP faction led by Seyi Makinde, governor of Oyo and Bala Mohammed, governor of Bauchi from going ahead with its national convention slated for November 15 and 16 in Ibadan.

Justice James Omotosho, the presiding judge, ruled that the evidence before the court showed that the party failed to hold valid state congresses before the planned convention as stipulated in the 1999 constitution and INEC guidelines, as well as its own constitution.

Lamido had sued the party for allegedly denying him the opportunity to purchase the chairmanship nomination form to enable him participate in the convention.

On November 11, Peter Lifu, another Federal High Court judge, issued a temporary order restraining the party from proceeding with the planned convention pending the determination of a substantive suit filed by Lamido.

On November 14, he made a final order restraining the PDP from conducting its national convention.

In his judgment, Lifu held that the evidence before the court established that Lamido was “unjustly denied” the opportunity to obtain a nomination form to contest the position of national chairman of the party, in violation of the PDP constitution and its internal regulations.

The Nigerian Army has arrested one of its personnel for alleged gunrunning, even as troops rescued eight kidnap victims and recovered arms and ammunition in recent operations across the country.

A credible source at Army Headquarters disclosed this on Monday in Abuja.

He said the soldier, identified as Lance Cpl. Saifullahi Garba (14NA/72/15972), was arrested in Marte local government area of Borno State with 711 rounds of 7.62mm ammunition.

According to the source, preliminary findings showed that the soldier had been accumulating the ammunition from clearance operations with the intent of supplying terrorists.

“He has since been handed over to the appropriate authorities for further action.”

The source also confirmed that troops in Bama intercepted terrorists’ logistics movement and recovered 379 rounds of 7.62mm ammunition.

READ ALSO: Cautionary concerns in conflict communication, By Tunde Akanni

He added that ambush operations by troops in Borno and Yobe led to the recovery of two AK-47 rifles, 11 rounds of ammunition and other items, with one terrorist neutralised.

In the North-Central, the source said troops rescued three more kidnap victims in Nasarawa, in addition to five earlier rescued.

He said the troops of Operation Whirl Stroke recovered 579 rustled cattle and two AK-47 rifles from armed herdsmen responsible for earlier attacks in Taraba.

In the South-South, the source said the troops of Operation Delta Safe arrested 10 armed suspects in Rivers disguised in OSPAC uniforms.

According to him, troops seized five pump-action rifles, locally made guns, charms, mobile phones and ₦1.7 million cash, while a separate raid in Ahoada East neutralised two cult leaders.

“These operations demonstrate both the army’s resolve to deny terrorists and criminals freedom of action and its vigilance to deal decisively with any betrayal within the ranks,” he said.

The Nigeria Football Federation, NFF, has appointed Manu Garba as Head Coach of Nigeria’s U-17 Men’s team, the Golden Eaglets, while Moses Aduku takes charge of the National U-20 Women’s team, the Falconets.

In a statement by Ademola Olajire, NFF’s Head of Communications, on Friday, said both coaches would officially resume on Sunday, as their different teams had important upcoming engagements.

Garba had earlier guided the team to win the FIFA U17 World Cup trophy – for the fourth time in the nation’s history, at the United Arab Emirates in 2013.

He has also led the team on two occasions since then, including qualifying the team for the 2019 FIFA U17 World Cup finals in Brazil.

On the other hand, Aduku is highly respected in women’s football coaching, having led Bayelsa Queens and Edo Queens football clubs with distinction in recent years.

He was assistant coach of the Nigeria U20 girls, the Falconets, as they reached the quarter-finals of the FIFA U20 Women’s World Cup finals in Costa Rica in 2022.

The U20 girls have a 2026 FIFA U20 Women’s World Cup qualifying fixture against Rwanda in September, while the Golden Eaglets will take part in the WAFU B U17 Boys Tournament that Nigeria is set to host the same month.

When the President called to inform me of his decision to magnanimously confer on me the National Award of Commander of the Federal Republic, CFR, on account of my much advertised role in the struggle for the validation of the June 12th election and affirmation of Chief MKO Abiola’s mandate, my first reaction was why only me and not all those unsung heroes. Those officers and men who actively participated in that struggle, risking their careers and even lives.

Although I was one of the leaders of that movement within the military, my contribution was by no means bigger than theirs. While I have been recognised and celebrated, including this National Honour by the President, they have remained anonymous.

It is therefore incumbent upon me to reveal the identity of these patriots if only to acknowledge and commend their contributions to the emergence of the current democratic dispensation. The fact that Chief Abiola, the presumed winner of the June 12th election won over 80% of the Armed Forces votes, clearly demonstrated the contribution of the other members of the military. I should add that this list is by no means exhaustive. There are a lot more participants who have remained unknown to me since they served under others. I apologise to all those whose names I must have missed. May God recognise and reward your sacrifice.

Top on my list is my deputy at the Armoured Corps Centre and School, Col MA Garba, whose commitment was so strong that he continued with the execution of our plans after some of us were arrested, detained and mercifully retired in October, 1993. He went on, as he should, to attain the enviable rank of a Major General in the army. Others are:

-Lt col Lawal Jaafaru Isa.

-Lt col UF Ahmed.

-Lt col MS Dasuki.

-Lt col ML Gwadabe.

-Lt col J. Temlong.

-Lt col Musa Shehu.

-Lt col Chris Eze.

-Lt col HM Dzarma.

-Lt col Isa Jibrin.

-Lt col JOS Oshanupin.

-Lt Col A Oloruntoba (kabiesi Olugbede of Gbede kingdom).

-Lt col Moke.

-Lt col Happy Bulus.

-Lt col Olagunsoye Oyinlola.

-Col J Okai.

-Col E. Ndubueze.

-Lt Col Yakubu Muazu.

-Lt col Yahaya Abubakar (current Etsu Nupe).

-Major Saad Abubakar (current Sultan of Sokoto).

-Maj Abba Maimalari.

-Maj Jamil Tahir.

-Maj Buzugbe.

-Maj LP Aprezi.

-Maj MK Yake.

-Maj J Dawah.

-Maj Suleiman Wali.

-Maj Dauda Komo.

-Maj Lucky Torrie.

-Maj JS Zaruwa.

-Maj M Sumaye.

-Maj Sani Bawa.

-Maj Ndaliman.

-Maj Ahmed.

-Maj M Bawa.

-Lt col JB Ahmadu.

-Capt Junaid Bindawa.

-Capt Lar.

Mr President must lead in a war against sycophancy in all its forms. This must allow for no exceptions including the rapidly growing trend of naming and renaming public institutions, facilities and other infrastructure after a President or State Governor while in office.

I therefore accept this award with all sense of humility on behalf of all these officers and men. Obviously, it goes without saying that this award will be doubly more meaningful if the democracy we all fought for delivers the real dividends. This can happen only if leaders at all levels govern with the fear of God and in accordance with the tenets of democracy. It remains the hope and prayers of all patriots that nothing is done to derail this infant democracy.

To achieve the stability and progress of our democracy, leaders must prioritise good governance over politicking for self-aggrandizement. The three co-equal branches of government must operate independently while cooperating with each other.

One enduring lesson from the conduct of the officers and men is their decision to operate above sycophancy but to hold their superior officers to account. Sadly, this does not appear to have a positive impact on our political leaders. Sycophancy everywhere has become the scourge of selfless and accountable leadership. It is the reason for the arrogance and vanity we see in our leaders at all levels. Men of straw are widely and falsely being elevated to the position of icons by self-seeking sycophants. Mr President must lead in a war against sycophancy in all its forms. This must allow for no exceptions including the rapidly growing trend of naming and renaming public institutions, facilities and other infrastructure after a President or State Governor while in office. The other day, the Senate President was reported to have predicted that President Bola Tinubu will win the 2027 election with 99.9% of the votes! Even allowing for the fact that this Senate President is widely known for his humorous incitement, Mr President will do well to shun such oracles.

God bless Nigeria.
