										<content:encoded><![CDATA[<p>The Bureau of Public Procurement, BPP, is set to host a stakeholder forum with contractors, consultants, service providers, and other key actors in Nigeria&#8217;s public procurement ecosystem in Lagos on February 26th, 2026, at the Sheraton Hotels, Ikeja.</p>
<p>The forum, supported by the Foreign, Commonwealth and Development Office, FCDO, and the Partnership for Agile Governance and Climate Engagement, PACE, aims to discuss the Methodology for Assessing Procurement Systems, MAPS, framework and its role in strengthening public procurement processes in the country.</p>
<p>A statement issued by the Head of Press and Public Relations Unit at the Bureau of Public Procurement, Mr. Zira Zakka Nagga, listed the key objective of the meeting to include engaging contractors, consultants, service providers, and civil society organisations in a dialogue on the MAPS framework and its benefits for Nigeria&#8217;s procurement system; and providing opportunities for stakeholders to offer feedback and input on the development of a National Procurement Strategy.</p>
<p>The meeting, according to the statement, also aims to align Nigeria&#8217;s procurement reform agenda with the roles of all stakeholders in its successful implementation.</p>
<p>It listed participants at the meeting as including representatives of government institutions, private-sector operators, professional bodies, civil society organisations, and development partners involved in procurement oversight, advocacy, and service delivery.</p>

										<content:encoded><![CDATA[<p>Nigeria has won 6.2 million dollars arbitration case against the European Dynamics UK Ltd, an international technology contractor, with which it entered into a dispute through the Bureau of Public Procurement, BPP.</p>
<p>Mr Kamarudeen Ogundele, Senior Assistant on Communication and Publicity to the Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi, SAN, made this known in a statement.</p>
<p>The ministry said that the European Dynamics UK Ltd, an international technology contractor had entered into a dispute with the BPP over a national e-Procurement project.</p>
<p>It noted that the ruling which was final and not subject to appeal was dismissed by Mrs Funmi Roberts, the Sole Arbitrator when the tribunal sat at the International Centre for Arbitration and Mediation, Abuja.</p>
<p>“The tribunal dismissed the contractor’s claims in their entirety, relieving Nigeria of potential financial exposure estimated at over 6.2 million dollars (approximately ₦9.3 billion) in claimed payments and damages.</p>
<p>“The European Dynamics UK Ltd had claimed approximately 2.4 million dollars for alleged milestone completions, 3 million dollars in general damages and an additional 800,000 thousand dollars settlement claims.’’</p>
<p>It added that the Director-General of the BPP, Dr Adebowale Adedokun, inherited a stalled technology project together with ongoing arbitration proceedings upon resumption in office.</p>
<p>Prior to Adedokun’s appointment, there had been discussions around an out-of-court settlement but the bureau, however, elected to continue with the arbitral process, maintaining that payments must be tied strictly to demonstrable value delivered.</p>
<p>The underlying contract concerned the design, development, customisation, supply, installation and maintenance of a national electronic Government Procurement (eGP) system financed with support from the World Bank.</p>
<p>The project aimed to strengthen transparency, accountability and efficiency across federal public procurement processes.</p>
<p>Central to the dispute was the User Acceptance Test (UAT).</p>
<p>The UAT carried out by the BPP identified significant functional deficiencies, including critical omissions and errors affecting system performance.</p>
<p>The bureau argued that unlike conventional supply contracts where delivery might occur upon physical handover, software customisation projects were performance-validated.</p>
<p>That delivery crystallises only upon satisfactory UAT confirming that the system operates in accordance with the technical requirements, statutory workflows, and operational environment for which it was commissioned.</p>
<p>The ministry noted that the tribunal accepted Nigeria’s position that the deficiencies fell within the vendor’s responsibility to remedy at no additional cost.</p>
<p>It further held that the contractor, as the technical expert, bore the obligation to ensure that the delivered system complied with contractual requirements irrespective of earlier technical documents that might have been approved by the BPP.</p>
<p>The tribunal also found no evidence that the bureau consented to the merger of multi-phase modules into a single phase and nothing in the contract suggests that such a merger is permissible, particularly given that payment is structured in phases.</p>
<p>Consequently, the tribunal dismissed all claims by European Dynamics UK Ltd in their entirety and ruled that the contractual framework was distorted.</p>
<p>The ministry  also noted that Adedokun, during a formal presentation of the award to the minister of justice, described the outcome as an important signal for public sector technology contracting.</p>
<p>“This particular vendor has taken various African countries to court and won every single case.</p>
<p>“Nigeria is the first to defeat them. We stood our ground against one of the best legal teams in the world because we believed in the expertise of our own Nigerian legal professionals,” he said.</p>
<p>He expressed appreciation to the minister for approving the proceedings, noting that without such support, Nigeria would have lost billions of Naira that could now be spent on critical national development.</p>
<p>The AGF commended Adedokun’s courage and the brilliance of the legal team adding that Nigeria is a country blessed with both natural and human resources.</p>
<p>“This win sends a clear message to the international community: Nigeria has resonated. It is no longer business as usual. By standing up to European Dynamics, we have instilled courage in other African nations to protect their own resources,” he said.</p>
<p>The minister commended the president for sustained support to institutional strengthening within the justice sector, saying “We have a leader, mentor and father that can always watch our back.”</p>
<p>The statement noted that the legal representative for the BPP encouraged the incorporation of lessons from the arbitration into ongoing e-procurement reforms to strengthen contract performance oversight and reduce the risk of future disputes.</p>
<p>It added that the Nigeria’s legal team was led by Johnson &amp; Wilner LLP, a Nigerian business and technology law firm, with Basil Udotai, Founding Partner, leading the arbitration together with the firm’s strategic partners and associates.</p>

<p>The meetings, scheduled for February 17th and 26th, 2026, in Kano and Lagos respectively, aim to discuss the Methodology for Assessing Procurement Systems, MAPS, framework and its role in strengthening public procurement processes in the country.</p>
<p>A statement issued by the Head of Press and Public Relations Unit at the Bureau of Public Procurement,  Mr Zira Zakka Nagga, listed the key objectives of the meetings to include engaging contractors, consultants, service providers, and civil society organisations in a dialogue on the MAPS framework and its benefits for Nigeria&#8217;s procurement system; and providing opportunities for stakeholders to offer feedback and input on the development of a National Procurement Strategy.</p>

<p>The newly approved &#8220;Nigeria First&#8221; policy prioritises Nigerian industries and contractors in all public procurement activities and is a key component of President Bola Ahmed Tinubu&#8217;s Renewed Hope Agenda.</p>
<p>The call was made on Monday by the Director General Bureau of Public Procurement, Dr Adedokun Adebowale, in a statement he issued.</p>
<p>The BPP commended President Bola Ahmed Tinubu and the FEC for the strategic policy initiative to enhance local industries&#8217; capacity, competitiveness, and sustainability.</p>
<p>“In light of this development, the BPP urges all MDAs and procurement stakeholders to familiarise themselves with the policy details articulated by the Honourable Minister of Information and National Orientation, Alhaji Mohammed Idris, during the post-FEC briefing to the State House Press Corps,” the statement reads in part.</p>
<p>The BPP said to ensure effective implementation, it stood ready to engage with procurement officers and stakeholders to develop and operationalise a Local Content Compliance Framework.</p>
<p>That, it said, would provide clear guidelines and support mechanisms for achieving compliance regarding the policy&#8217;s objectives.</p>
<p>It explained that the standard Bidding Document is one of the newly revised 17 Standard Bidding Documents.</p>
<p>“In collaboration with our development partners, BPP is now training procurement officers and contractors on its use in the ongoing capacity-building programme in the six geopolitical zones.</p>
<p>“Furthermore, a comprehensive Guideline on Local Content Compliance will be issued. Relevant stakeholders will be invited to provide input to enrich the document and foster shared ownership of the implementation process,” the statement reads in part.</p>
<p>BPP added that it would brief the public to create awareness and build widespread support for the policy.</p>
<p>The engagements, it said, would ensure clarity, transparency, and a broad-based understanding of the new requirements.</p>

<p>A further Circular from the Secretary to the Government of the Federation, SGF, it said, would be issued to reinforce the implementation mandate across all government institutions, providing additional policy direction and compliance expectations.</p>
<p>It said the president directed that the Attorney-General of the Federation, AGF, should issue an Executive Order to give full legal backing and enforceability to the new policy directives, ensuring nationwide compliance and institutional reinforcement.</p>
<p>It stated further: “Specifically, the BPP notes and reaffirms its commitment to executing the following Presidential Directives:</p>
<ul>
<li>Immediate revision and enforcement of procurement guidelines to prioritise locally made goods and indigenous solutions.</li>
<li>Establishment of a Local Content Compliance Framework applicable to all federal government procurements.</li>
<li>Create and maintain a register of high-quality Nigerian manufacturers and service providers regularly engaged by the government.</li>
<li>The BPP, as the designated line agency, supervises the deployment and management of procurement officers in all MDAs without compromising operational efficiency.</li>
</ul>
<p>“Accordingly, the BPP directs all MDAs to undertake the following actions with immediate effect:</p>
<ul>
<li>Ensure that locally available goods and services are prioritised in all procurement activities. Procurement of foreign goods or services must not proceed without justification and prior written waiver from the BPP. o Where local options are unavailable, contracts must include provisions for technology transfer, local production, or skills development. • Conduct an immediate audit of all current procurement plans and submit revised versions that align with the &#8220;Nigeria First&#8221; policy. • Strictly observe the directive that policy violations will attract sanctions, including cancellation of procurement processes and disciplinary actions against erring officers.”</li>
</ul>
<p>The BPP congratulated all Nigerians on adopting the “transformative policy, which is expected to create employment opportunities, stimulate domestic production, and foster sustainable national development.”</p>

										<content:encoded><![CDATA[<p>Mr. Isaiah Yesufu, a Director of Certification, Compliance and Monitoring at the Bureau of Public Procurement, BPP, on Monday testified against former Aviation Minister, Hadi Sirika.</p>
<p>The Economic and Financial Crimes Commission, EFCC, charged Sirika and his brother, Ahmad, and two companies with abuse of office and contract fraud.</p>
<p>The contract was for the construction of the terminal building at Katsina Airport.</p>
<p>Yesufu, who is a prosecution witness, said this in his evidence at the trial of the former minister that the BPP was not aware of the split in contract.</p>
<p>They are being prosecuted on a 10-count charge before Justice Suleiman Belgore, bordering on abuse of office, criminal breach of trust, and use of position for gratification.</p>
<p>The anti-graft commission alleged that the former minister awarded various contracts to his younger brother to the tune of about N19.4 billion.</p>
<p>The EFCC alleged that Sirika did confer an unfair advantage upon Enginos Nigeria Limited whose alter ego is his biological brother, Ahmad, by using his position to influence the award of a contract for the construction of a terminal building at Katsina Airport to tune of N1, 345,586,500.</p>
<p>It further alleged that the former minister used his position to influence the award of a contract for the establishment of Fire Truck Maintenance and Refurbishment Centre at Katsina Airport for the sum of N3, 811,497,685.</p>
<p>It also, among others, alleged that Ahmad and Enginos Nigeria Limited had possession of the aggregate sum of N2,337,840,674.16 which they knew indirectly represented the proceeds of criminal conduct of the former minister.</p>

<p>The defendants, however, pleaded not guilty to the charge preferred against them.</p>
<p>Testifying, Yesufu told the court that a bidder for any contract must submit an affidavit stating that the company did not have any relationship with the procuring entity.</p>
<p>“If there is a relationship this shall amount to a conflict of interest and should be disclosed.</p>
<p>“The affected officer of either the procuring entity or the BPP will recuse himself from participating in the process (of award of contract),” Yesufu told the court.</p>
<p>He said that in the case of the award of a contract for the construction of a terminal building for the Katsina airport, the ministry of aviation sought approval to adopt a restricted tendering method due to time constraints.</p>
<p>He added that approval was granted in favour of five companies, including Enginos Nigeria Limited.</p>
<p>Yesufu further told the court that after the approval was granted, the ministry completed the procurement process and awarded two contracts:</p>
<p>One of the contracts was in favour of Enginos, and the second was in favour of Al-Buraq according to him.</p>
<p>“The Bureau was not aware how a single contract, titled, “Construction of Katsina airport terminal building and Apron was eventually awarded as two separate contracts.</p>
<p>“I became aware of the split of the contract when I was invited by EFCC, where I made the statement,” he said.</p>
<p>The witness told the court that Enginos Nigeria Limited was awarded the contract to construct the Katsina airport terminal building at a cost of N1 345 586 500.</p>
<p>At this point, the prosecution counsel, Rotimi Jacobs (SAN), prayed for an adjournment to enable him to sort out some documents, to which the other parties did not object.</p>
<p>Justice Belgore subsequently, adjourned until April 8 to continue PW3’s evidence.</p>

										<content:encoded><![CDATA[<p>An Economic and Financial Crimes Commission, EFCC, witness told an Abuja High Court that the company of former aviation minister, Hadi Sirika, was not among five companies listed as bidders for the contract for the Apron Extension at Katsina Airport .</p>
<p>The witness, Isaiah Yusuf, who testified as EFCC 4th witness (PW4) said this in his testimony on alleged N2.7 billion against Sirika and three others.</p>
<p>The EFCC dragged him alongside his daughter, Fatima; Jalal Sule Hamma and Al-Duraq Investment Limited, for abuse of office and contract fraud.</p>
<p>They are standing trial before Justice Sylvanus Orji on six counts.</p>
<p>The minister who served under former President Muhammadu Buhari was accused of abusing his office as minister through the award of contracts to a company in which his daughter and her husband had interest.</p>
<p>The offence allegedly committed by the former minister and others, according to the prosecution, were contrary to Sections 12 and 19 of the Corrupt Practices and Other Related Offences Act 2000, to Section 17 (b) of the Economic and Financial Crimes Commission (Establishment) Act, 2004.</p>
<p>In addition, Section 315 of the Penal Code Act, Cap 532 Acts of the Federal Capital Territory and punishable under the same sections.</p>
<p>Yusuf who was led on evidence by the prosecution counsel, Rotimi Jacobs, said he was Director, Procurement, Bureau Public Procurement, BPP.</p>
<p>He said on March 16, 2022 a letter was received from the Ministry of Aviation requesting for letter of ‘no objection’ to enable the ministry award contracts with restricted publicity.</p>

<p>He told the court that the contract was below N1.5 billion, which the ministerial tender board could approve.</p>
<p>The witness added that if the amount was above the N1.5billion, the BPP would issue ‘certificate of no objection’ that would enable the ministry or agency request to proceed to Federal Executive Council, FEC, for approval.</p>
<p>Yusuf further said that after the approval was given, it would go back to the ministry or agency that placed the request.</p>
<p>“The Ministry of Aviation wrote two letters to BPP dated May 16 and May 17 requesting for ‘due process no objection’ for restricted advertisement for bidders.</p>
<p>“The ministry brought names of selected companies,  five in number  for  the building of terminal and extension of Katsina Airport.</p>
<p>“BPP approved the five listed companies for the contract for N800 million but Al-Duraq Global Investment Limited and Apron Expansion were not on the list,” he told the court.</p>
<p>Yusuf told the court that by the time the approval was given to the ministry, the BPP received any communication.</p>
<p>“It was when the EFCC contacted the BPP that we got to know that the project was split into two with costs at N1.4 billion and N1.3 billion.</p>
<p>“The BPP Act, section 16(6) must be strictly adhered to before bidders can be awarded contracts.</p>
<p>“The actual cost of the project brought to the BPP for evaluation was N800 million…</p>
<p>“We do not know how the project turned into two contracts and how the Al-Duraq Global Investment Limited and Apron Expansion were awarded the contract,” the witness said.</p>
<p>Meanwhile, Justice Oriji adjourned until July 5, for cross-examination of the witness.</p>
