										<content:encoded><![CDATA[<p>The Pan Niger Delta Forum, PANDEF, has inaugurated a high-powered peace and reconciliation committee, in a move to halt the deepening political crisis in Rivers.</p>
<p>The committee, chaired by a former Attorney-General of the Federation, Kanu Agabi (SAN), was given two weeks to resolve the standoff threatening governance and stability in the state.</p>
<p>The intervention came amid rising political tension, following impeachment moves against Gov. Siminalayi Fubara and his deputy, Prof. Ngozi Odu, by the state House of Assembly.</p>
<p>The forum’s board of trustees co-chairman, Alfred Diete-Spiff, expressed optimism that the initiative would lead to genuine reconciliation and lasting peace in the oil-rich state.</p>
<p>Diete-Spiff, while urging the committee to work expeditiously, said that Rivers, given its strategic economic and political importance to Nigeria, could not afford prolonged political turmoil.</p>
<p>PANDEF’s national chairman, Godknows Igali, said both the Minister of the Federal Capital Territory (FCT), Nyesom Wike, and Fubara, who are members of PANDEF, were expected to respect the outcome of the reconciliation process.</p>
<p>According to him, the moral authority of the organisation and the pedigree of the committee members would compel all parties to submit to dialogue and compromise in the interest of the people.</p>
<p>“It is our belief that, as committed members of PANDEF and leaders with a stake in the Niger Delta, all parties involved will respect the process and abide by the outcome of the committee’s work,” Igali said.</p>
<p>In his address, Agabi described the assignment as a solemn responsibility, thanking PANDEF’s leadership for the trust reposed in the panel.</p>
<p>He paid glowing tribute to Diete-Spiff, describing him as a symbol of sacrifice, unity and enduring commitment to the South-South and the Nigerian nation.</p>
<p>“The duty of respect we owe to a man like that demands that we take his intervention seriously,” Agabi said, noting that Rivers’ current predicament calls for wisdom, restraint and humility from all actors.</p>
<p>The former minister warned that the crisis, if allowed to fester, would raise questions about the commitment of the political actors to the welfare of the people of the state and the broader national interest.</p>
<p>“We cannot afford to stand by and do nothing as Rivers, whose talents and resources continue to bless the nation, struggles with issues of political power.</p>
<p>Agabi, who acknowledged personal relationships with both Wike and Fubara, appealed to them to lead the reconciliation process by example, urging them to rise above personal grievances for the sake of peace.</p>
<p>The seven-member committee’s terms of reference include: identifying key actors in the crisis; engaging critical stakeholders such as former governors, traditional rulers and political leaders.</p>
<p>The committee is also expected to facilitate dialogue between the executive and legislature; restoring stability and law and order as well as ensuring that any resolution aligned with constitutional norms and the democratic will of the people.</p>
<p>The panel was also mandated to consult widely, maintain confidentiality to build trust and submit a comprehensive report with recommendations to the president and PANDEF’s Board of Trustees within 14 days.</p>

										<content:encoded><![CDATA[<p>Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, IPOB, on Thursday, announced the disengagement of his legal team led by Chief Kanu Agabi, SAN, at the Federal High Court in Abuja.</p>
<p>Kanu, who told Justice James Omotosho at the resumed hearing, said he was willing to defend himself.</p>
<p>Following the IPOB leader’s decision, all the senior advocates in the team, including Chief Agabi, former Attorney-General of the Federation, AGF, withdrew their continuous appearance in the case.</p>
<p>Against this development, Kanu, who is currently addressing the court from the dock, challenged the jurisdiction of the court to try him.</p>
<p>Kanu had, in a motion he personally signed and filed on October 21, listed former Attorney-General of the Federation (AGF), Abubakar Malami, and others as his witnesses in his ongoing alleged terrorism trial.</p>
<p>The motion is entitled “Notice of Number and Names of Witnesses to be Called by the Defendant and Request for Witness Summons/Subpoena and the Variation of the Time Within Which to Defend the Counts/Charges against the Defendant.”</p>
<p>It listed many dignitaries as witnesses.</p>

<p>Among those Kanu listed as “compellable witnesses” are the Minister of FCT, Nyesom Wike; a former Minister of Defence, retired Gen. Theophilus Danjuma and a former Chief of Army Staff, retired Gen Tukur Buratai .</p>
<p>Others are Gov. Babajide Sanwo-Olu of Lagos State and Gov. Hope Uzodimma of Imo; Minister of Works, Dave Umahi; the immediate-past Governor of Abia, Okezie Ikpeazu; the immediate-past Director-General, National Intelligence Agency, NIA, Ahmed Abubakar.</p>
<p>Others are former D-G of the State Security Service, Yusuf Bichi, and several witnesses whose identities he didn’t reveal.</p>
<p>Kanu, in the motion, promised to “provide the sworn statements of all voluntary witnesses to this honourable court, and to notify the prosecution within a reasonable time.”</p>
<p>IPOB leader held his private consultation with his legal team at the FHC in Abuja on Wednesday.</p>
<p>Kanu, who was brought to court by the operatives of the Department of State Services, DSS, met with members of his legal team in Justice James Omotosho’s court as earlier ordered.</p>

										<content:encoded><![CDATA[<p>The Federal High Court will, on Monday, hear a motion filed by Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, IPOB, seeking an order transferring him to Abuja National Hospital for urgent medical attention.</p>
<p>Justice Musa Liman had granted the motion ex-parte praying for the permission of the court to hear the application during the vacation period in view of its urgency.</p>
<p>Justice Liman, who fixed September 15 for the hearing, ordered Kanu’s lawyer, Uchenna Njoku, SAN, to serve all the processes and the hearing notice on the Department of State Services, DSS, in order for the security agency to respond appropriately.</p>
<p>“I believe that the right to health is as important as the right to life.</p>
<p>“And so I agree that this matter can be heard by the vacation court,” Justice Liman, who is also a vacation judge, had said.</p>
<p>Kanu, in the ex-parte motion with charge number: FHC/ABJ/CR/383/2015, had sought a relief.</p>
<p>Kanu, in the motion dated September 2 but filed on September 3 by Chief Kanu Agabi, SAN, sought an order “granting leave for the applicant’s motion dated 1st September, 2025 to be heard before the vacation judge.”</p>
<p>Giving an 11-ground argument why their request should be granted, Agabi said Kanu is presently standing trial before Justice James Omotosho in charge marked: FHC/ABJ/CR/383/2015.</p>

<p>He said Kanu, on May 19, filed an application praying the court to admit him to bail pending the hearing and determination of the terrorism charge.</p>
<p>The lawyer, however, said that the said application could not be taken before the annual vacation of the court, hence his continued detention.</p>
<p>According to him, while awaiting the resumption of the court activities, the applicant’s health took a worrisome decline, necessitating the invitation of doctors for the purpose of carrying out a thorough and extensive examination on the applicant.</p>
<p>“The examination revealed issues to his health including organs such as his pancreas and liver as well as an emerging lump underneath his armpit and dangerously low levels of potassium.</p>
<p>“The doctors have recommended that he be moved to the National Hospital as an interim measure to afford him medical attention and forestall further decline.</p>
<p>“The applicant’s health is seriously deteriorating considering the nature of his confinement thereby making more pressing, the need to bring this application and have same heard by a vacation judge,” Agabi said.</p>
<p>He alleged that a letter by the doctors to the Director-General of the DSS, advising the transfer of Kanu had gone without answer.</p>
<p>He said the urgency of the matter had, therefore, necessitated the filing of the instant application as a measure to arrest further decline of his health while spirited efforts are being expended to ensure his treatment.</p>
<p>The senior lawyer said that the grant of the application would not occasion any injustice on the complainant, DSS.</p>
<p>Besides, Agabi said the court “is imbued with jurisdiction to hear and grant the prayers sought in the application.”</p>
<p>Emmanuel Kanu, the younger brother to Nnamdi Kanu, in the affidavit he deposed to, averred that the IPOB leader recently complained of weakness and pains in his body.</p>
<p>He said thiat “prompted the invitation of doctors led by the Eminent Emeritus Professor Austin A.C. Agaji, who on 1st September, 2025 at about 2:30pm,” told him that several tests were conducted on Kanu in August.</p>
<p>Emmanuel said the doctor told him, at Agabi’s law firm, that it was discovered that the IPOB leader was suffering from issues relating to his liver and kidney as well as dangerously low level of potassium.</p>
<p>“He was further diagnosed of a swelling around his armpit area which requires urgent attention to ascertain the cause and thereafter to seek appropriate medical treatment,” he averred.</p>

										<content:encoded><![CDATA[<p>A witness in the  trial of Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, IPOB, on Tuesday, said the IPOB leader admitted inciting members of the public to attack police officers during interrogation.</p>
<p>The witness, a Department of State Service, DSS, operative, identified as BBB for security reasons, told Justice James Omotosho of the Federal High Court in Abuja, while being led in evidence by the federal government’s lawyer, Chief Adegboyega Awomolo, SAN.</p>
<p>BBB, who was the 2nd prosecution witness (PW-2), gave his testimony behind a screen provided by the court.</p>
<p>The witness said beside being the leader of the IPOB, Kanu is also the founder of the Eastern Security Network, ESN, the armed wing of IPOB.</p>
<p>He said Kanu also operated an illegal radio station, which broadcast on frequencies 102.1 FM and 88.0 FM.</p>
<p>BBB told the court that the radio was illegal because it was not licensed by the National Broadcasting Commission, NBC.</p>
<p>When the lawyer asked if the PW-2 had had encounter with Kanu, the witness said he got to know Kanu when he was assigned the duty of taking his statement on July 17, 2021, following a letter from the Attorney General of the Federation, AGF, requesting that the IPOB leader be investigated in respect of his alleged terrorism activities.</p>
<p>The DSS operative said the AGF’s letter was addressed to the director general of the service.</p>
<p>He said he carried out the assignment in the company of four other of his colleagues, including a director.</p>
<p>He said he handed Kanu the letter from the AGF, which the defendant read and also gave his lawyers to read, following which he requested that Kanu respond to issues raised in the letter.</p>
<p>He said after reading the letter, Kanu volunteered to make a statement in the presence of two of his lawyers, including Alloy Ejimakor.</p>
<p>The witness said he played some of the broadcast made by the defendant on his radio station, known as Radio Biafra, including where he called for the attack on police officers and other inciting comments.</p>
<p>BBB said Kanu admitted that the broadcast, which he played to his hearing, were his (Kanu’s) own.</p>
<p>When Awomolo asked what Kanu was agitating about, the witness said Kanu wanted the secession of the five South East states, part of Kogi and part of Benue from the rest of Nigeria.</p>
<p>He said the statement-taking session was also recorded on video.</p>
<p>When Awomolo sought to tender the AGF’s letter and a copy of the video disc, the defence lawyer, Chief Kanu Agabi, SAN, objected.</p>
<p>Agabi argued that the letter and the disc were not included in the proof of evidence served on them.</p>
<p>Agabi said it was part of the right of the defendant to be given copies of all documents and materials that the prosecution planned to rely on in prosecuting the case.</p>
<p>He sought an adjournment to enable the prosecution do the needful.</p>
<p>But when Awomolo argued that non-service of those documents should not hinder the proceedings, Agabi submitted that if served with the documents, they would need time to study them and consult with Kanu.</p>
<p>Awomolo, who reminded that he took up the case recently, said non-service of these documents could be a mistake.</p>
<p>He, however, said he was ready to furnish the defendant with all the necessary documents and materials that the prosecution wished to rely on.</p>
<p>He also conceded to the case being adjourned.</p>
<p>Ruling, Justice Omotosho held that the defence was entitled to all the documents and materials the prosecution planned to rely on.</p>
<p>The judge then proceeded to order the prosecution to, in line with the provision of Section 36 of the Constitution, serve on the defendant all facilities, including documents that it intends to rely on to prosecute the case.</p>
<p>Justice Omotosho subsequently adjourned the matter until May 7 to enable the prosecution serve the defence all the necessary documents and for the PW-2 to continue his testimony.</p>
<p>Earlier, the PW1, also a DSS operative identified as AAA, concluded his testimony after being cross-examined by Agabi and re-examined by Awomolo.</p>
<p>Under cross-examination by Agabi, the witness said he was consulted, in relation to the role he played in the case as an investigator, before the charge in the case was filed.</p>
<p>The witness said he was not aware that the defendant was charged with 15 counts, but that he was aware that Kanu was charged with inciting others to attack members of the police force.</p>
<p>“I was not part of the drafting of the charge, but I am aware that he (the defendant) incited people to kill members of the police force,” he said.</p>
<p>The witness also said that he was not aware that a count relating to the allegation was struck out from the charge in an earlier ruling.</p>
<p>He also said he was not aware that eight out of the 15 counts contained in the original charge were struck out by the court in an earlier ruling.</p>
<p>Before the day’s proceeding commenced, Justice Omotosho expressed concern over issues of representation by lawyers in the matter.</p>
<p>The judge said due to the small size of the court, long list of lawyers in company of the lead counsel for the prosecution or defendant would not be accommodated.</p>
<p>“I want to make this clarification, I approved 16 counsel for the defence out of the 29 counsel,” he said.</p>
<p>He said a lawyer, Charles Udeh, wrote a letter to the court, stating that he was the counsel for the defendant and also copied Aloy Ejimakor in the letter.</p>
<p>“He said his name is on the list but based on my order, his name was removed,” the judge said.</p>
<p>Justice Omotosho then asked Kanu to tell the court who his lawyer is and the IPOB leader pointed to Chief Agabi as his legal representative in the matter.</p>

<p>The judge also called Mrs Favour Kanu, who is the wife of Kanu’s younger brother, Prince Fineboy, to step forward and explain her reason behind recording the court proceedings live.</p>
<p>The judge expressed surprise that despite that Mrs Favour’s phone was confiscated on the last adjourned date when she was caught recording him, she still went ahead to post the video online.</p>
<p>“I want to hear from her. Were you not the one that I took your phone?</p>
<p>“I did not give order to forfeit that phone. I don’t know if she might be a wife to my brother (Nnamdi Kanu),” the judge said, but Prince told the judge that Favour is his wife.</p>
<p>Justice Omotosho, who said that anyone is free to record or take video of the court before sitting, said as soon as the judge begins proceedings, such act will be contemptuous.</p>
<p>Responding, Favour said: “Thank you my lord for giving me the opportunity to say something. I will never never disrespect the court.</p>
<p>“I did not know that you were still seated my lord, because it was a live video.</p>
<p>“Immediately you cautioned me, the video had already gone and there was nothing I could do at that time. It was a live stream on Facebook.”</p>
<p>Although Kanu’s lawyer, Chief Kanu Agabi, SAN, also apologised on her behalf and appealed for forgiveness, Justice Omotosho insisted that Mrs Favour would be barred from three proceedings.</p>
<p>The judge said he did not want to be forced to create another room where some of the lawyers and litigants would be made to sit to observe the court proceedings through zoom.</p>
<p>Justice Omotosho, who cautioned against any act that could cause delay in the trial, assured all parties in the case that justice would be served.</p>

										<content:encoded><![CDATA[<p>Nnamdi Kanu, the leader of the proscribed Indigenous People of Biafra, IPOB, on Friday, said he acted in anger when he verbally attacked the former trial judge, Justice Binta Nyako, of the Federal High Court in Abuja.</p>
<p>Kanu, through his new counsel and former Attorney-General of the Federation (AGF) and Minister of Justice, Chief Kanu Agabi, SAN, tendered an apology to the judge and the court.</p>
<p>The IPOB leader also apologised to the Federal Government’s lawyer, Chief Adegboyega Awomolo, SAN, for his attack on the senior lawyer.</p>
<p>Besides, he tendered an apology to Kanu’s own team of lawyers earlier led by Aloy Ejimakor for castigating them without reservation before Justice Nyako.</p>
<p>Earlier when the matter was called, Agabi sought the court’s leave to deliver a message on Kanu’s behalf.</p>
<p>He said he had already discussed the development with the lawyer to the prosecution, Chief Awomolo, and he had agreed with him.</p>
<p>Justice Omotosho granted the application.</p>
<p>Agabi, in the message titled: “Apology By Mazi Nnamdi Kanu Delivered on His Behalf by Kanu G. Agabi, SAN, CON,” urged everyone to forgive his client.</p>
<p>According to Agabi, we may have reason to be angry but we must be careful what we say when we are angry.</p>
<p>“That is why we are urged not to sail in a storm. The defendant in this case, Nnamdi Kanu was angry.</p>
<p>“He has been angry for a long time and therefore, he should not have spoken when he was angry.</p>
<p>“But he did. And he said the wrong things. He attacked the court. He attacked the prosecutor. He attacked his own lawyers.</p>
<p>“For that reason, he has authorised me to apologise on his behalf.</p>
<p>“He is sorry for his attacks on the judge, on the prosecutor and on his defence team.</p>
<p>“Firstly, I apologise to the Hon. Justice Binta Nyako. She is one of our best and most respected judges. She did not deserve the attacks upon her.</p>
<p>“They were unjustified.</p>
<p>“We apologise to Chief Adegboyega Awomolo, SAN, Chairman of the Body of Benchers and leader of the Body of Senior Advocates of Nigeria in Abuja.</p>
<p>“Chief Awomolo has since distinguished himself by his humility, his dedication to the profession.</p>
<p>“He deserves our highest respect,” he said.</p>
<p>Agabi equally apologised to Kanu’s team of lawyers earlier led by Aloy Ejimakor for castigating them without reservation.</p>
<p>“It is a credit to the members of that team that they still agree to defend him.</p>
<p>“It is clear from all that has transpired that he acted in anger.</p>
<p>“He spared no one. But by behaving the way he did, he imperiled himself more than any other person.</p>
<p>“I appeal to all those he offended to forgive him,” the ex-AGF begged.</p>
<p>According to him, “I think of him as a good man.”</p>
<p>“We cannot all be of one mind. I respect the fact that when he felt that he had cause to disagree, his courage did not fail him to take a stand.</p>
<p>“And I respect the fact that when the government felt that he had exceeded the bounds of law, measures were taken to correct him.</p>
<p>“Like all men and women, he is not perfect. He holds himself out as representing, the cause of the Igbos.</p>
<p>“On my part, I see the Igbos, as a people who are irrepressible. They are a forward looking, hardworking and intelligent people.</p>
<p>“They are a very resilient people. They are an adventurous and fearless people.</p>
<p>“Who can oppress such a people? There are, in the nation, communities that can be described as oppressed, but surely not the Igbos.</p>
<p>“The Igbos are a people who, even now, are rendering a good account of the talents that God gave them.</p>
<p>“They have never wallowed in self-pity. There is urgent need to plead the cause of the oppressed in this country.</p>
<p>“A strong and fearless voice such as Nnamdi Kanu will aid that cause. And if he does so, that is what will truly immortalise him and exalt the name of the Lord and serve the cause of the unity of our country.</p>
<p>“I commend to us all the example of Col. Fajuyi, a Yoruba man, who laid down his life for Gen. Aguiyi Ironsi, an Igbo man.</p>
<p>“These are the kinds of men and women that the nation shall remember and immortalise,” he said.</p>
<p>Agabi said there is a time for all things.</p>
<p>According to him, this is the time for peace.</p>
<p>“We can and must make peace. The nation is rife with misgivings. There will always be misgivings.</p>
<p>“A time will never come when, as a nation, we shall all be of one mind.</p>

<p>“Whatever our misgivings, therefore, whether on the part of the government or the citizens, we must make allowance for error and proceed with prayer for forgiveness, just in case we may be wrong.</p>
<p>“In resolving our differences therefore, we must strive to save and not to destroy. Let us employ methods of peace and non-violence to resolve our differences.</p>
<p>“We must unite. Whether we are Christians or Muslims, whether we come from the east or the west, the north or the south, we must never lose sight of the fact that we are all children of God and citizens of one nation.</p>
<p>“We must reach out to one another across state and religious lines. We must forget the past and forge a new nation of peace, founded on truth and justice.</p>
<p>“The Nigeria of my dream is that in which Nigerians of whatever religion or tribe, whatever their states of origin, will hold high offices in states other than their own.”</p>
<p>He urged all Nigerians to strive for a more integrated, more united, more efficient and more peaceful nation.</p>
<p>His words: “We must all work ceaselessly for peace and unity. No price is too great to be paid for peace.</p>
<p>“We are never going to have peace until we are willing to go the extra mile, to turn the other cheek and to add our coat when our cloak is taken.</p>
<p>“We should not lose sight of the supreme price that the Son of God Himself paid that we may have the peace that we are now dissipating.</p>
<p>“As he took our burdens upon himself in order that we may be reconciled to God, so we must be willing to take upon ourselves the burdens of one another so that, together we can build a nation of righteousness and peace.”</p>
<p>Citing a biblical allusion, Agabi tasked all Nigerians to let the peace and unity of the country be paramount in all they do.</p>
<p>After Kanu’s lawyer concluded the reading of the message, Justice Omotosho asked Chief Awomolo to respond to the letter.</p>
<p>Responding, Awomolo who said he was moved by Kanu’s plea, said he had forgiven him for all that he said against him.</p>
<p>He said he was not a persecutor as misconceived by Kanu but a prosecutor, and that he, together with Agabi, would do their duty professionally towards ensuring that the matter is expeditiously disposed of.</p>
<p>“We understand the heat in the land over this matter, and I and Chief Agabi, SAN, will do our duty to ensure that this matter is expeditiously disposed of,” he said</p>
<p>Awomolo thanked Agabi for delivering Kanu’s message, describing the ex-AGF as “a man who has served this nation with all his knowledge.”</p>
<p>He admitted that Kanu’s lead counsel spoke to him earlier on the matter and that he gave him a copy of the message and sought his permission to read it in the open court.</p>
<p>“I want to say that I have forgiven all that Kanu said about me,” he said.</p>
<p>The judge said though he was not there when they had the agreement, he was also moved to tender apology on Kanu’s behalf.</p>
<p>Justice Omotosho said when he read the case file from page to page, he discovered that the trial started in 2015.</p>
<p>He said back then when the trial began, Kanu was 47 years old.</p>
<p>“Now, our brother is 57 years. For 10 years, he has faced trial.”</p>
<p>“If someone faces trial for 10 years without knowing where he is going, it is enough to offend anybody</p>
<p>“I apologise on his behalf,” the judge said.</p>
<p>Quoting Mathew 23:23, Justice Omotosho said the Holy Bible lays emphasis on three key words; justice, faith and mercy.</p>
<p>He said justice must be administered with mercy and faith.</p>
<p>He said whatever one does, one must know that one would surely give account to God in the last day.</p>
<p>“Therefore, justice is the key word. We will do justice according to the law and according to our conscience. God be with us, we will achieve that.</p>
<p>“We have to do justice speedily. We cannot afford to allow this case to take another 10 years,” he said.</p>
<p>Justice Omotosho thanked the two senior lawyers for their disposition to the matter.</p>
<p>Shortly after this, Kanu was re-arraigned on amended seven-count charge bordering on terrorism.</p>
<p>The IPOB leader, however, pleaded not guilty to all the counts and the judge ordered an accelerated hearing of the matter.</p>
<p>Justice Omotosho then adjourned the matter until April 29, May 2 and May 6 for trial.</p>

										<content:encoded><![CDATA[<p>The Supreme Court, on Tuesday, reserved judgment in the suit filed by 19 states challenging the constitutionality of the laws establishing the Economic and Financial Crimes Commission, EFCC, and two others to a date to be communicated to the parties.</p>
<p>The plaintiffs, in the suit marked: SC/CV/178/2023 had argued that the Supreme Court, in Dr. Joseph Nwobike Vs Federal Republic of Nigeria, had held that it was a UN Convention against corruption that was reduced into the EFCC Establishment Act and that in enacting this law in 2004, the provision of Section 12 of the 1999 Constitution, as amended, was not followed.</p>
<p>The argument was that, in bringing a convention into the Nigerian law, the provision of Section 12 must be complied with.</p>
<p>According to them, the provision of the Constitution necessitated the majority of the states&#8217; Houses of Assembly agreeing to bringing the convention in before passing the EFCC Act and others, which was allegedly never done.</p>
<p>The argument of the states in their present suit, which they had reportedly been corroborated by the Supreme Court in the previous case mentioned, is that the law, as enacted, could not be applied to states that never approved of it, in accordance with the provisions of the Nigerian constitution.</p>
<p>Hence, they argued that any institution so formed should be regarded as an illegal institution.</p>
<p>At the resumed hearing on Tuesday, Imo, Bauchi and Osun states joined the suit as co-plaintiffs while Anambra, Ebonyi and Adamawa states announced their decisions to withdraw their suits.</p>
<p>The Attorney-General of the Federation, Lateef Fagbemi, SAN, who was present in court as the Defendant, had craved the court&#8217;s indulgence to take the process they filed on Tuesday morning.</p>
<p>Justice Uwani Abba-Aji thereby granted leave to the defendant to use the reply on point of law filed on Tuesday.</p>
<p>Mohammed Abdulwahab, SAN, who appeared for the 1st Plaintiff, pointed out that the amended processes filed by the AGF were different from what had initially been filed, noting that he had to refile his processes to answer to the fresh issues and facts.</p>
<p>The old processes were therefore struck out.</p>
<p>&#8220;I seek your lordship indulgence to adopt the processes. We urge your lordship to grant all the reliefs sought.</p>
<p>&#8220;The crux of our suit is the decision of this court. The counsel that represented the appellant in that suit by the rules of this Court Order 4, will be called to address this court. He participated in the bill that birthed the EFCC and ICPC together,&#8221; he said.</p>
<p>The judge asked who the Counsel was and Wahab, SAN, replied: Chief Kanu Agabi, SAN.</p>
<p>&#8220;Chief Kanu Agabi, SAN, told this court that it was the Convention of the UN that reduced this into law. Section 12, that provision was never followed.</p>
<p>&#8220;This fact was not an issue with the case of AG Ondo Vs AG Federation. So there is a specific provision for bringing a convention in. You cannot just be talking about Items 7 of 8.</p>
<p>&#8220;We are also challenging the foundation of those laws that created NIFU, EFCC, etc. in order not to create a constitutional crisis.</p>
<p>&#8220;We urge you to allow our appeal and award heavy cost in favour of the Plaintiff on record,&#8221; the Counsel said.</p>
<p>Responding, Fagbemi, SAN, contended that the case of AG Ondo v. AG Federation and other decisions had already settled all the issues raised in the Plaintiffs&#8217; case and that the Supreme Court could not depart from those decisions.</p>
<p>He therefore prayed that the suit be dismissed.</p>

<p>On AG Ekiti State Vs AGF, Counsel for the Defendant, T. A Gazali, SAN, pointed out that the state was not represented at the last sitting and was not also represented on Tuesday.</p>
<p>&#8220;We apply that the matter be struck out for want of diligent prosecution my lord,&#8221; Gazali prayed. This was granted.</p>
<p>The Attorney-General of Osun State, Oluwole Jimi-Bada, SAN, informed the court of their application for consolidation of their suit with that of Kogi State.</p>
<p>&#8220;We have an application before your lordship and with your kind permission, we are ready to proceed. It is an application for consolidation,&#8221; he said.</p>
<p>The judge, however, said the interesting thing about the case was that they were already part of the matter.</p>
<p>&#8220;So why do you want to consolidate? Judgment has already been reserved.&#8221;</p>
<p>Justice Abba-Aji reserved judgment for a date to be communicated to the parties.</p>
<p>On Tuesday, the number of states challenging the constitutionality of the EFCC and others had climbed to 19, including Kogi State, despite the withdrawal of three states.</p>
<p>The court ruled that the judgment on Kogi State would be applied to Ogun, Nasarawa and Osun states that had earlier applied for consolidation.</p>
<p>The states in the suit Vs AGF are Kogi; Kebbi; Katsina; Sokoto; Jigawa; Enugu; Oyo; Benue; Plateau; Cross River; Ondo; Niger; Edo; Bauchi; Imo; Osun; Nasarawa; Ogun and Taraba.</p>
