The Senate has rescinded its earlier decision and re-passed the Electoral Act amendment Bill, retaining the proviso on Clause 60(3) that allows for manual transmission of election results if electronic transmission fails.

The proviso indicates that presiding officers can transmit results electronically, but if the system fails, they can use Form EC8A as a backup.

This development followed the adoption of a motion sponsored by the Senate Leader, Sen. Opeyemi Bamidele (APC-Ekiti) at plenary on Tuesday.

The bill was passed after a clause-by-clause consideration.

Bamidele, in the motion entitled: “Motion for Rescission and Re-Commital,” said the Electoral Act, 2022 (Repeal and Enactment) Bill, 2026 was duly considered and passed by the Senate and the House of Representatives.

He said upon further critical review of the bill as passed, it was observed that the 360-day notice requirement prescribed in Clause 28 might result in the scheduling of the 2027 presidential and national assembly elections within the period of Ramadan.

He said that the coincidence of the elections with the Ramadan period could adversely affect voters’ turnout.

According to him, it can also affect logistical coordination, stakeholder engagement and the overall inclusiveness and credibility of the electoral process.

He said upon painstaking scrutiny of the bill, discrepancies were identified in the Long Title and Clauses 6, 9, 10, 22, 23, 28, 29, 32, 42, 47, 51, 60, 62, 64, 65, 73, 77, 86, 87, 89, 93 and 143.

That, he said, affected other clauses of the bill, including issues relating to cross-referencing, serial numbering and internal consistency.

Bamidele said that a technical committee comprising the leadership of both chambers, members of the conference committee, clerks of both chambers and legal drafting experts from Directorate of Legal Services of the National Assembly met to harmonise and address the identified anomalies.

He said that there was the need to ensure that electoral timelines and statutory provisions promote maximum participation, fairness, inclusivity, administrative efficiency and public confidence in the electoral system.

The senate leader said that the upper chamber resolved to rescind its decision on the bill out of its desire to correct the identified inconsistencies and unintended consequences through appropriate legislative action.

He added that the decision was also aimed at safeguarding the integrity of the electoral framework and relying on the provisions of Orders 1(b) and 53(6) of the Senate Standing Orders (as amended).

“The senate accordingly resolves to: rescind its decision on the electoral act, 2022 repeal and enactment bill, 2026 as previously passed; and re-commit the bill to the Committee of the Whole for comprehensive reconsideration and necessary amendments,” he said.

In spite of the rescission of amendment and re- enactment of bill, the earlier approved clause 60(3) was still retained alongside its proviso.

The clause earlier passed by the senate had mandated electronic transmission of election results from polling units to the Independent National Electoral Commission’s, INEC, Result Viewing Portal, IReV, but with conditions.

According to the clause, results shall be transmitted electronically after the prescribed Form EC8A has been signed and stamped by the presiding officer and party agents.

However, if electronic transmission fails due to communication issues, the result contained in Form EC8A signed by the presiding officer and or countersigned by polling agents shall be the primary source of collation and declaration of results.

Before the passage, Sen. Enyinaya Abaribe (APGA-Abia), during the clause-by-clause consideration of the bill, had raised a point of order in response to clause 60(3), calling for division to vote on the clause.

However, Deputy Senate President, Barau Jibrin (APC-Kano), said it would be out of order to raise a point of order on a matter that had been concluded, saying that the senate had concluded on the clause in the previous passage of the bill.

Barau was, however, shouted down by some opposition lawmakers.

Bamidele, however, saved the controversy which was already degenerating into a shouting brawl, when he interjected, saying: “Abaribe’s point of order calling for a division was in order.”

The majority leader said that his motion on rescission of the passed bill was in the overriding public interest and to preserve the integrity of the senate.

He said that the call for division by Abaribe was in order and consistent with his motion, which was for new legislative input on the earlier passed electoral bill by the senate.

The senate, thereafter, went into division to decide on the proviso on clause 60(3), which eventually received the support of the majority of the lawmakers who are of the ruling All Progressives Congress (APC).

The lawmakers who voted in support of the proviso were 55, while those who were not in support were 15.

Senate President, Godswill Akpabio, in his remarks, thanked the senators for their act of patriotism, saying that their action was display of democracy.

“I thank particularly those who had the courage to stand up and answer their fathers’ names by showing so much courage to vote against the proviso in clause 63(3).

“You showed overwhelming courage; you were able to prove democracy at work.

“I also want to thank those who voted for the proviso to remain, that you have saved democracy by making sure that we don’t go on continuous re-runs and repeat of elections.

“I want to also thank the senate for introducing electronic transmission of polling unit results through the portal to the IReV.

“This will now make it possible for even monitors, including foreigners who monitor our results, who are not able to visit the 176,000 polling units in Nigeria, to see the polling unit results dropping into the IReV.

“This is a major innovation since 1960. With this, senate’s stance should be applauded. I thank you for your innovation that we should undertake this.

“This will enable all the political parties to protect the results of their candidates. Congratulations to all for ensuring a smooth election in 2027,” Akpabio said.

By LANRE OGUNDIPE

“Oh, I am very weary, though tears no longer flow; my eyes are tired of weeping, my heart is sick of woe” -Anne Brontë

Poor electricity generation with the unabated collapse of the national grid should be a major concern to every Nigerian. One wonders how the country has put up with this malaise, over the years. Our national grid, which is the lifeline of the nation’s electricity generation, has become what the Yorubas call ‘abiku’! The Nigerian electricity sector, managed by one of the world’s largest publicly quoted utilities, and entrusted to serve the electricity need of millions of Nigerians, never fails to live up to its billing as a perennial failure. Our national grid is perennially down! This national failure breaks my heart.

These endless breakdowns have raised perpetual questions that seem to receive no feedback. The question l ask myself is this: on whose curse are we operating? Besides this, shouldn’t we talk about “our” insatiable greed that has become our Achilles heels as a people? Certainly, not only the leaders are guilty, even the led are culpable. Truly, those saddled with the responsibility in that sector have demonstrated that they lack the skill and will to deliver the service that Nigerians desperately needed. The problem with electricity supply to Nigeria’s teeming population has lingered for ages with no end in sight.

Tales from that sector have shown repeatedly, that its management is as opaque as the NNPC, and its operations undergirded by selfish interest, wrapped in multi-coloured cloaks and disguises. Like their comrade in deceit, Nigeria’s electricity sector has been managed by mafia-kind of clique for decades. Whether state – operated or state-enthroned private operators, the story is the same. They are unmoved by the agony and pain they inflict on Nigerians by denying them access to safe and reliable energy supply, on which contemporary socio-economic life is built, globally.

Their conscience has been seared with red hot iron of selfishness. The major hallmark of responsibility like patriotism, probity and accountability have lost relevance if these virtues ever existed in the first place. The officials as well as contractors are united by greed and corrupt self-enrichment at the detriment of the people’s well-being, and the economic growth of the country. It is business as usual as the supervisory authority too has turn lame duck – no monitoring, no due diligence, they care less about performance records. Anything goes – it’s free-for-all.

The highest authority unarguably, is inexcusably culpable in the sleaze, palm-greasing and knavery across all cadres of administrations by officials and major contractors. These have been the major factors that have rendered the energy sector ineffective and underperforming. Rather than attend to the needful, everyone including the government, turn blind eyes to the plundering of the nation’s resources in the guise of contracted maintenance, that have failed to yield tangible outcome.

READ ALSO: Solid minerals corporation will be an enduring legacy –Alake

Emerging facts, from the government and the legislative arms, as the grid went down again few days into the new year, shows that the energy sector is swimming in a deep ocean of trouble. The incessant breakdown, is a misnomer that has been normalized in a society where the king dances naked. Perhaps interpreted from the disclosure about dismal happenings in the sector, we should condition our minds to it that darkness is a permanent feature of the Nigerian life, at least in the near future!

It was disturbing that 5 days into the new year, the national grid had, as announced, collapsed for the umpteenth time within a space of 365 days. It is very shameful that the bewildered Power Minister, Adebayo Adelabu, had to disclose to the public that the national electricity grid will remain vulnerable to collapse as a result of government’s inability to repair a key transmission line. He attributed this to the delay in repairs stalled by the insecurity in the northern part of the country where the grid is located. What a confession! A confession that portrays the government as incapable of effective governance or admittance of incompetence! He stressed that the failure is exacerbated by the grid’s fragility, leading to frequent collapses.

Adelabu made the disclosure while speaking during the 2025 budget defense session with the Senate Joint Committee on Power. He highlighted the critical damage to the Shiroro-Kaduna-Mando transmission line, which has been out of service since October 2024 following vandalism incident. As if that was not disturbing enough, the Chairman Senate Committee on Power, Senator Enyinnaya Abaribe submitted a damming report which indicted actors in the power sector of practically fleecing the nation and its citizens. His disclosure was stunning to say the least and extremely embarrassing. He stated that the nation requires the sum of $25 million or N42 billion to restart the grid each time it collapses. Scandalous you would say?

The image he presented is alarming. To think that the country lost such a huge sum 12 times last year and will continue the wastage this year, necessitates a judicial probe or enquiry to expose those behind the sordid racket and their sponsors.

Adams Oshiomole, the former Edo State governor and NLC President on the Senate floor, requested the legislature to revisit the government decision on the privatization of the energy sector. Adams slammed the operators as a bunch of inefficient individuals, with no professional abilities who had subjected people to harrowing experiences and fleecing the nation without providing the services while the government that owns majority shares in trust for the public has no representation on the Management boards of these companies. These companies, according to Oshiomhole, are parasites living large on tax payers’ money with the connivance of the power – wielding elites in government. He appealed that only the second arms of the government – the legislators – could liberate the masses from the claws of these unsavory vampires in the country.

With all sense of seriousness, so far, l have not been able to put a finger of discernment on the present administration’s stance on corruption, or any semblance of readiness to combat the scourge. The bunch out there have no credibility whether perceived or real. Leaders are enmeshed in series of grafts and unaccountable expenditure, that leaves one wondering if this nation would ever enjoy breath of fresh air. Government officials have their hands soiled with corruption in every sector, including energy.

The Abaribe reports call for “decisive actions” by the government on the saboteurs including those within and outside the system to pay for their culpability. I wonder which government Abaribe is calling on! Once or twice, a spirited attempt was made by me to have a Nigerian version of Abraham Lincoln epitaphic words “to immortalize heroes of democracy in their land.” We need courageous people who will damn the consequences of cartels and cliques who are bent on continued pauperization of the nation. People of courage who will devote their resources and goodwill to nation building in all sectors while putting the future of the country and welfare of its people as their first priority.

The pathetic story of the nation’s inability after 65 years of Independence to generate adequate electricity for its population, leaving the nation wallowing in acute darkness, is highly unsettling, and deserves government’s urgent attention.

It is regrettable, that in our own depraved situation, personal and parochial interests come first. It is an irony of some sort when spanners are put to enable other factors are thrown that would inhibit the job performance. Yet, we are quick to point our shortest fingers to what obtains in saner climes where due diligence is observed to achieve quality results for the good of all. Our pretensive leaders hardly find the quality governance obtainable elsewhere attractive or desirable in our clime but are quick to make swift reference to the occasional ‘negatives’ in the developed world. Their jaundiced narratives, are deployed as smoke screen, to pull wool over people’s faces to cover their looting and unbridled exploitation, while pretending to serve with equity and justice. I ask, would it not fare better, for us to adopt a narrative that would give clear perspectives on the kind of democracy we practice in Nigeria?

As it were, our democracy can be best described as “government of the corrupt by the corrupt and for the corrupt”. A country where commitment to development is mere lip service. We have not in any way honoured or sustained the legacy of our heroes and their sacrifices for the nation’s development. What we have so far showcased, is contrary to their ideals and ethos. It’s fraud all the way in every sector!

The fraud in the energy sector is too sickening to gloss over. Abaribe-led team has spoken. Unfortunately, the leadership of the Red Chambers may not be decisive or trusted to act in good conscience, as the headship of the chambers themselves are yet to prove they are above board. For the upper legislative arm to be forthcoming on this, the house must first remove the logs of wood in its eyes before looking in other directions for specks and splinters replete in the system. This report must not be one of the reports to be thrown to the dustbin or consigned into the waste bin of history. It requires digging-deep which we assume would further exhume can of worms that may smear the leadership and those connected with them either directly or remotely.

Careful dissection of Adelabu and Abaribe’s comments unearthed the crux and the unspoken meanings underlining the gaps in the perceived fraud and greed of government officials acting in connivance with contractors fleecing the nation with impunity while caution is thrown to the wind in the process. This is why the fragile grid will never work!

The Minister acknowledged that grid collapses are likely to continue “but assured that efforts are being made to minimize their frequency and ensure faster restoration times.” The point of the issue which the power anchorman ignored or waved aside is the fact that the system is built on nepotism, deception, and corruption, which had eaten deep into the operational system like a cankerworm and may not allow for effective turnaround if the clogs are not removed.

Late last year, the EFCC Chairman, Olanipekun Olukoyede while playing host to visiting House of Representatives Committee on oversight function to EFCC Headquarters, Jabi, Abuja, cried out on financial crimes. He expressed concern at the rate the national grid collapsed 4 times within the spate of 72 hours. Olukoyede remarked that dubious practices are the major causes of frequent equipment failures, outages and grid collapses. He noted further that the under-performance of the country’s budgets in the last 15 to 20 years falling below 20 per cent, is adding to the burden of some of the electricity companies purchasing sub-standard machinery and tools to facilitate electricity supply in the country. This, according to him, has contributed largely to the misfortune of frequent collapses of the national grid. Olukoyede’s worries hinged on poor implementation and execution of capital projects in the country. He added that Nigeria cannot achieve infrastructural or any form of growth under such conditions.

He said “Investigations carried out by the EFCC showed that contractors in the power sector, who were awarded projects to supply electrical equipment often opt for substandard materials.”

He pointed out that the spate of collusion and sharp corrupt practices of officials in the power sector remain a concern that government must fight seriously. He noted that what the anti-graft agency is grappling with in the energy sector would cause heart attack and make a fair-minded Nigeria to shed tears.

Findings further revealed that Nigeria’s national electricity grid has collapsed more than 200 times in the last nine years, regularly resulting in widespread blackouts. The power outages, prevent people from meeting routine business and household needs, with resultant huge economic and social costs.

In sub-Saharan Africa, every 1% increase in power outages (in terms of hours) has been associated with a 2.86% decrease in gross domestic product (GDP). This translates to a loss of about US$28 billion in GDP. How would a developing nation with this great loss grow to meet up with other top notch-economies in the world?

The pathetic story of the nation’s inability after 65 years of Independence to generate adequate electricity for its population, leaving the nation wallowing in acute darkness, is highly unsettling, and deserves government’s urgent attention. To achieve a turnaround, the government must studiously resolve to find lasting solution to the corrupt practices in the energy sector that have stalled efforts at achieving stable power supply and thus increase the boom of importation of generators into the country.

Should we remain ever a clueless bunch watching our rulers ride rough shod on us while we continue to lament until we all die miserable deaths?

Minister of Power, Mr Adebayo Adelabu, has said that the federal government plans to increase power generation from 4000 Megawatts to 6000 by the end of 2024.

Adelabu said this in Abuja on Monday when the members of the Senate Committee on Power visited the ministry.

The minister said the federal government planned to achieve the 6000 megawatts of power using the hydro and solar plants to increase supply of electricity to households and businesses.

He described as unfortunate and sad, a situation where the highest electricity currently being generated stood at only 5800 megawatts.

“The infrastructure are lying there, without adequate maintenance, the turbines are rusting away.

“With proper investment put in place, we can generate 6000 megawatts before the end of 2024,” he said.

The minister also said that the federal government was going to transform the Electricity Distribution Companies, (DisCos) adding that they were the last mile in the power supply industry.

According to him, if they don’t perform, it means the entire power sector is not performing.

“We are putting pressure on the Nigerian Electricity Regulatory Commission, NERC, to ensure that the DisCos sit up and if they have to withdraw their licenses for not performing, why not?

“We are unbundling the DisCos along state lines as some of them are too big for efficiency and effectiveness.

“Some of them are serving so many states, so we are rearranging and restricting the DisCos along state lines, so that each state government will know the distribution company responsible for their states,” he said.

The minister said it was time the federal and state governments started exercising their rights in the management and operations of the power sector.

READ ALSO: Troops eliminate scores of terrorists in Niger ambush

“We have left it for the private sector for too long and they have messed it up.

“We also plan to franchise the DisCos so that we can have smaller DisCos that are ready to invest,” he said.

Earlier, Sen. Eyinnaya Abaribe, Chairman of the Committee, had said that they were in the ministry for an oversight function.

Abaribe said that the oversight visit became necessary to find out the challenges that had led to poor supply of electricity to Nigerians and also the reasons for the consistent collapses of the national grid.

He said the committee, in pursuant to the rules and regulations of the National Assembly, had already invited the ministry of power and its parastatals for an investigative hearing on the increase in tariff by April 29.

Abaribe said, “This is with regards to payment for power by Nigerians, so, we won’t want to discuss that before the date.”

“The committee has already invited the minister and his agencies to discuss the issue of increase in tariff extensively with the committee,” he said.

The Senate has rejected the controversial bill seeking to extend the service year for employees of National Assembly by additional five years.

The bill, which had been passed at the House of Representatives was declined for concurrence by the Senate on Thursday at plenary.

There were mixed reactions amongst lawmakers in the Senate after the Senate Leader, Sen. Opeyemi Bamidele (APC-Ekiti) introduced the bill for concurrence.

While Sen. Sumaila Kawu (NNPP Kano) spoke in support of the bill, others, including Senators Enyinnaya Abaribe (APGA-Abia) and Ali Ndume (APC Borno) expressed reservations over the bill, saying that it would cause disaffection in the Nigerian civil service.

READ ALSO: Tinubu appoints new AMCON management team

Abaribe said he was against the passage of the bill, because there was no difference between a staff of National Assembly who has a special knowledge as Director of Finance and a Director of Finance in Federal Ministry of Finance.

Abaribe said: “I have also looked at the retirement age for University Lecturers and Judicial Officials which we passed about the same time.

“And coming down to the officers of the National Assembly, I asked a simple question: What is the difference between the person who is a Finance Director in National Assembly and that in the Ministry of Finance?

“I do not see what separates the person who works inside here as a staff of National Assembly from the person who works in the Ministry of Commerce as a staff.

“We must not allow somebody to stay here beyond the rules of public service of Nigeria on retirement year.”

Ndume on his part, reiterated the contentious nature of the bill and urged the lawmakers to be careful in processing it.

The lawmaker urged his colleagues to repudiate the bill for further consultation.

Senate President, Godswill Akpabio, after his ruling declared that the bill was repudiated because it was controversial.

The Returning Officer for Abia South National Assembly election, Prof. Georgina Ugwuanyi, announced this before party agents at the collation centre in Aba.

Earlier, Ugwuanyi had told party agents that a substantial number of polling units totalling about 108 had irregularities requiring a reschedule of the Abia South election.

She said that Abaribe, the All Progressives Grand Alliance, APGA, candidate, got the highest number of votes in the election, having scored 49, 903 votes.

The Senate on Thursday approved the request of the Federal Government to borrow the sum of $22.7 billion.

The request – 2016- 2018 External Borrowing Plan – which was made by President Muhammadu Buhari, it was stated, was to enable the government carry out infrastructural projects across the country.

The Senate’s approval was given after the consideration of the report of the Committee on Local and Foreign Debts presented by its chairman, Senator Clifford Ordia, Peoples Democratic Party, PDP, Edo Central.

There was confusion at a point during the consideration.

While the Minority Leader, Senator Enyinnaya Abaribe, PDP, Abia South, wanted an exhaustive consideration of the report and the recommendation before the approval, the Senate President thought the legislators should simply go into its recommendations and vote.

Following the deadlock that ensued, the legislators went into a closed door session after which the approval was given.

The request for the approval was made in a letter to the Seante on November 28, 2019 by President Muhammadu Buhari and dated November 26, 2019.

It was read on the floor of the Senate by Ahmad Lawan, the senate president.

The Presidency has described as foolish, Senate Minority Leader, Enyinnaya Abaribe’s call on President Muhammadu Buhari to resign over the state of insecurity in the country.

Abaribe made the call while contributing to a debate on the state of insecurity at the plenary of the Senate on Wednesday.

He said the president had failed to tackle the problem of insecurity hence he should leave.

But in a response to the call, the Presidency dismissed Abaribe as an arm chair critic known for “stray comments.”

In a statement issued by the Senior Special Assistant to the President on Media and Publicity, Mallam Garba Shehu, the Presidency said his opinion did not represent that of the country.

The Presidency said rather, Abaribe should resign for unlocking the door to enable the escape of the leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu Nnamdi Kanu.

The statement by the Presidency reads:

SENATOR ABARIBE’S CALL ON PRESIDENT BUHARI TO RESIGN IS FOOLISH

President Buhari to resign on what basis?

Just because some characters think that President Buhari should resign, then they expect him to quit. That call does not represent the opinion of the country. This is the opinion of an arm chair critic, known for making stray comments.

If a leader like President Buhari needs to resign, there are millions of other Nigerians who need to resign, including Senator Abaribe who unlocked the door to enable the escape of traitorous and treasonable suspects.

He signed the bond for the court to release Nnamdi Kanu on bail, from which moment the suspect disappeared into the thin air. Senator Abaribe has failed repeated deadlines to return Kanu to the court for trial, yet he has the effrontery with which to accuse someone of failing to the bidding of the law.

This is a man who should have replaced the suspects he failed to produce in the correctional facility.

Abaribe’s party raped the nation and left it collapsing in 2015 and President Buhari is fixing things up all the years he is in office.

President Buhari is working hard to keep Nigeria and Nigerians out of the harm terrorists have unleashed in the entire Sahel and Sub-Saharan Africa with the support of Nigerians and our foreign friends, he is going to finish off these terrorists. He alone can do it.
